In this regard, Company shall maintain a complete and accurate system of accounts and records. (b) At least once each year and.within two months after completion of parent company's (Browning-Ferris Industries, Inc.) annual audit, Company will provide to City financial reports and such other documents as may be required by City of all appropriate Company affiliates, to include annual balance sheets and profit and loss statements as used in Company's and affilitates' audit. At such time after the receipt of said financial reports City may, with due notice, examine, inspect and review such books, accounts, vouchers and records as were used in preparing of such reports. If during the last six (6) months of the report period there shall have been a rise in operating costs over the 93 percent of service revenue allocated therefore, Company may request a raise in rates and shall provide City with a proposed new rate schedule. (c) If City finds and determines that the proposed rates are fair to the residents of City, and are required to maintain proper rate of return on investment and proper operating ratio between collections and expenses, it shall within sixty (60) days after receipt of such notice, authorize such increase by the adoption of a resolution to provide for such increase, and the new rate schedule shall forthwith become effective commencing with the calendar month next succeeding the effective date of such resolution. (d) In the event that City shall not have granted such increases within said sixty (60) days, the request for rate increase shall be determined by arbitration, and within said -8-
