Commission in establishing rates for common carriers engaged <br />in the trucking business. Said Operating Ratio Method allows <br />93 percent of the service revenue to cover all operating costs <br />and the remaining seven percent (7%) allocated to cover interest, <br />corporate taxes and profit. In this regard, Company shall <br />maintain a complete and accurate system of accounts and records. <br /> <br /> (b) At least once each year and.within two months after <br />completion of parent company's (Browning-Ferris Industries, <br />Inc.) annual audit, Company will provide to City financial <br />reports and such other documents as may be required by City <br />of all appropriate Company affiliates, to include annual balance <br />sheets and profit and loss statements as used in Company's <br />and affilitates' audit. At such time after the receipt of <br />said financial reports City may, with due notice, examine, <br />inspect and review such books, accounts, vouchers and records <br />as were used in preparing of such reports. If during the last <br />six (6) months of the report period there shall have been a <br />rise in operating costs over the 93 percent of service revenue <br />allocated therefore, Company may request a raise in rates and <br />shall provide City with a proposed new rate schedule. <br /> <br /> (c) If City finds and determines that the proposed rates <br />are fair to the residents of City, and are required to maintain <br />proper rate of return on investment and proper operating ratio <br />between collections and expenses, it shall within sixty (60) <br />days after receipt of such notice, authorize such increase by <br />the adoption of a resolution to provide for such increase, and <br />the new rate schedule shall forthwith become effective <br />commencing with the calendar month next succeeding the <br />effective date of such resolution. <br /> <br /> (d) In the event that City shall not have granted such <br /> increases within said sixty (60) days, the request for rate <br /> increase shall be determined by arbitration, and within said <br /> <br /> -8- <br /> <br /> <br />
