Section 3.2. Properties to Be Served; Frequency. Ail <br />Residential, Commercial and Industrial Property within the <br />Service Area of Agency shall be provided Solid Waste Collection <br />services by Company not less than weekly. The provisions of this <br />section shall not be deemed a limitation on any other provisions <br />hereof relating to the frequency or extent of such collections, <br />nor vice versa. <br /> <br /> Section 3.3. Solid Waste Disposal on Premises. The <br />franchise granted herein does not include Collection of Solid <br />Waste as is customarily disposed of in a sanitary manner by the <br />occupants of the premises on which such Solid Waste accumulates, <br />provided that such disposal meets with the requirements of all <br />applicable health and sanitary statutes, ordinances, and <br />regulations of the State of California, of any agency or <br />political subdivision thereof, this Agency or any other public <br />entity having jurisdiction over such matters. <br /> <br /> Section 3.4. Recycling. In.the event Agency determines to <br />institute a recycling program within its Service Area, Agency may <br />give written notice thereof to Company whereupon Agency and <br />Company shall endeavor in good faith to negotiate a supplement <br />hereto providing, among other matters, the rates chargeable to <br />customers for such service and compensation to Company; provided, <br />however, that such rates and compensation shall be determined and <br />calculated separately from the rate modification process <br />described in Section 6.2 such that the costs of recycling service <br />shall be borne solely by customers receiving such service within <br />Agency's Service Area.
