! <br /> <br />section, nothing herein shall be deemed to grant an exclusive <br />right to Company to participate in Agency's recycling program. <br /> <br /> Section 3.5. Hazardous Waste. The parties acknowledge that <br />upon the date hereof the County of San Mateo, California, <br />operates a Hazardous Waste collection program to serve <br />Residential Property including such Property within Agency's <br />Service Area. If, during the term hereof, such program should <br />cease and not be replaced by said County or any other agency <br />within Agency's Service Area, Agency may institute its own <br />program. In the event that Agency institutes a Hazardous Waste <br />collection program to serve Residential Property within Agency's <br />Service Area, Agency may given written notice thereof to Company <br />whereupon Agency and Company shall endeavor in good faith to <br />negotiate a supplement hereto providing, among other matters, the <br />rates chargeable to customers for such service and compensation <br />to Company; provided, however, that such rates and compensation <br />shall be determined and calculated separately for the rate <br />modification process described in Section 6.2 such that the costs <br />of the Hazardous Waste Collection Program shall be borne solely <br />.by customers receiving such service within Agency's Service Area. <br />Notwithstanding the provisions of this section, nothing herein <br />shall be deemed to grant an exclusive right to Company to <br />participate in Agency's Hazardous Waste program. <br /> <br /> Section 3.6. Obey Ail Laws. In the performance of its <br />duties hereunder Company shall obey all applicable laws, rules <br />and regulations, and shall Collect Solid Waste in a manner <br />consistent with the Solid Waste Management Plan of the County of <br />San Mateo, California (to the extent that such Plan governs such <br />9 <br /> <br /> <br />
