~ES:djk 08/31/87R <br /> <br />matters), applicable ordinances and other regulations of Agency, <br />and laws of the State of California as said Plan, ordinances, <br />regulations and laws may be amended, revised, or superseded <br />during the term hereof. <br /> <br /> Section 3.7. Ownership of Solid Waste. All Solid Waste <br />Collected by Company pursuant hereto shall become the property of <br />Company upon possession thereof by Company; provided, however, <br />that nothing in this section shall be deemed a waiver by Agency <br />or Authority of their respective rights and duties under this <br />agreement nor shall the provisions of this section be deemed to <br />affect any of the provisions of this agreement governing the <br />Collection of Solid Waste and designation of a disposal site or <br />sites therefor by Agency or Authority; provided, further, that <br />nothing in this section or agreement shall be deemed to affect <br />Agency's or Authority's rights to enter into agreements or <br />otherwise participate in programs or activities, or receive such <br />benefits as may accrue from any program or programs providing for <br />the transfer, disposal, resource recovery, or other disposition <br />of Solid Waste Collected by Company pursuant hereto. <br /> <br /> Section 3.8. Sanitary Provisions Applicable to Equipment. <br />Company shall use only sanitary equipment meeting the standards <br />of the Division of Public Health of the Department of Public <br />Health Services of the County of San Mateo (or such agency or <br />officer performing the functions of said Division as the same may <br />be renamed, redesignated, or reorganized from time to time during <br />the term hereof) for the Collection of Solid Waste, which <br />equipment shall be subject to the inspection of said Division or <br />its authorized designee at all times during the term hereof. <br /> <br /> 10 <br /> <br /> <br />
