DES:djk 08/31/87R <br /> <br />modification process described above. It is understood that <br />Agency, or Authority on behalf of Agency, shall endeavor to <br />complete its review by May 31 of each year for rates which are to <br />be effective not later than October 1 of the same year. <br /> <br /> (b) Company's Application. In addition to the rate <br />modification process described in Section 6.2, Company may also <br />apply to Agency for a change in rates at any time during the term <br />hereof. Such application shall only be based upon changes in <br />Operating Costs or Pass Through Costs from unanticipated causes <br />occurring prior to the next scheduled rate review by Agency, or <br />Authority on behalf of Agency. Such causes may include, but are <br />not necessarily limited to, implementation of new or revised <br />regulations which mandate, or circumstances which dictate, use <br />of new and different equipment, different disposal sites, or <br />different or new operating techniques or methods. <br /> <br /> If Company's application hereunder is based upon the <br />designation of a disposal site other than the site in use upon <br />the commencement date hereof (commonly referred to as the "Ox <br />Mountain" site) and said site is available to Company for use <br />hereunder, then the parties may a~ree to reclassify the elements <br />of disposal costs from Operating Costs and Pass Through Costs as <br />defined and described herein, and account for disposal costs <br />differently than as provided in Exhibit "A". Such <br />reclassification shall pertain solely to elements of disposal <br />costs and shall occur only in the event of the designation of a <br />disposal site other than that described above. <br /> <br /> (c) ~.ncy's Motion.
