DES:djk 08/31/87K <br /> <br />passive negligence or willful misconduct arising from the <br />performance of, or failure to perform, any work, duty, or <br />obligation required by this agreement of Company, its officers, <br />agents, and/or employees. The provisions of Section 7.3 <br />(Insurance) shall not be deemed a limitation upon Company's <br />duties and obligations under this section. <br /> <br /> Section 7.3. Insurance. (a) General. Company shall not <br />commence performance under this agreement until all insurance <br />under this section has been obtained or provided and has been <br />approved by Agency. Company shall furnish Agency with policies <br />of insurance or evidence of a self-insurance program providing <br />the required coverage and there shall be a specific contractual <br />liability endorsement or other specific provision extending <br />Company's coverage to include the contractual liability assumed <br />by Company pursuant to this agreement. The polices or program <br />shall provide that thirty (30) days' prior written notice must be <br />given to Agency of any proposed change in the limits of liability <br />or of any cancellation or modification of such policies or <br />program. <br /> <br /> (b) Workers' Compensation and Employer Liability Insurance. <br />Company shall take out and maintain during the term of this <br />agreement Workers' Compensation and Employer Liability Insurance <br />or provide through a self-insurance program full statutory <br />coverage therefor. Company hereby certifies as follows, pursuant <br />to Section 1861 of the California Labor Code: <br /> <br /> "I am aware of the provisions of Section 3700 of the <br /> Labor Code which require every employer to be insured against <br /> liability for workers' compensation or to undertake <br /> <br /> 32 <br /> <br /> <br />
