Company shall take out and <br />maintain during the term of this agreement Bodily Injury <br />Liability and Property Damage Insurance or provide through a <br />self-insurance program coverage protecting Company while <br />performing under this agreement from any and all claims for <br />damages for injuries to or death of any person, and any and all <br />claims for property damage, including loss of use thereof, which <br />may arise from Company's operations under this agreement, whether <br />such operations be by Company, its officers, employees and/or <br />agents, or by any subcontractor or by anyone directly or <br />indirectly employed by either Company or such subcontractor. The <br />amount of such coverage shall be Five Million Dollars <br />($5,000,000) combined single limit bodily injury and property <br />damage for each occurrence. Agency may, at its sole discretion, <br />require an increase in the amount of liability coverage to the <br />level then customary in similar Agency agreements by giving sixty <br />(60) days' prior notice thereof to Company; provided, however, <br />that no increase in the amount of liability coverage shall exceed <br />five percent (5%) of the amount current (including prior such <br />increases) in any Operating Year without Company's written <br />consent. Agency, Authority and their respective governing <br />bodies, commissions, boards, officers, agents and employees shall <br />be named or additional insureds on any such policies of insurance <br />or evidences of coverages, which shall also contain a provision <br />that the coverage afforded thereby to Authority, Agency and their <br /> <br /> 33 <br /> <br /> <br />
