DES:dft -/24/94 (008/62) <br /> <br /> FIRST AMENDMENT TO AGREEMENT <br /> FOR COLLECTION OF RECYCLABLE MATERIALS <br /> <br /> This FIRST AMENDMENT to the AGREEMENT FOR COLLECTION OF <br /> <br />RECYCLABLE MATERIALS (the "Recyclable Materials Collection <br />Agreement"), effective as of .~,~1 '~I , 1994, is made <br />by and between the CITY OF REDWOOD CITY, a municipal corporation <br />("Agency"), and BROWNING-FERRIS INDUSTRIES OF CALIFORNIA, INC., a <br />California corporation ("Company"); <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, Agency is a member agency of the SOUTH BAYSIDE <br />TRANSFER STATION AUTHORITY ("Authority"); and <br /> <br /> WHEREAS, Agency and the other member agencies of Authority <br />have granted to Company by separate agreements (viz., for Agency, <br />the Recyclable Materials Collection Agreement) the right to <br />collect and process Recyclable Materials generated within their <br />respective Service Areas, which separate agreements have been <br />adapted from the Uniform Franchise Agreement developed by <br />Authority for such purpose; and <br /> <br /> WHEREAS, Company has agreed to develop a facility with the <br />ability to process recyclables and thereby divert from the <br />landfill thirty percent (30%) of the Authority's member agencies' <br />waste ("Processing Facility"); and <br /> <br /> WHEREAS, Company has committed itself to develop, permit and <br />operate a "Green Waste" facility that will divert from the <br />landfill an additional twenty percent (20%) of the Authority's <br />member agencies' waste; and <br /> <br /> WHEREAS, Company has requested Agency, and Agency has <br /> <br /> <br />
