DES:dft /24/94 (008/62) <br /> <br />agreed, to amend its Recyclable Collection Agreement in exchange <br /> <br />for the development and operation of the aforesaid facilities; <br /> NOW, THEREFORE, BE IT AGREED AS FOLLOWS: <br /> <br /> The Recyclable Materials Collection Agreement, effective <br />August 25, 1988, is hereby amended as follows: <br /> <br /> 1. Section 4, TERM, shall be amended to state: <br /> <br /> "The term of this Agreement shall be the same as the <br /> term of the Uniform Franchise Agreement, as amended, and it <br /> shall be subject to the same extensions and to the same <br /> notices of determination not to extend as therein provided." <br /> <br /> 2. The last sentence of the first paragraph of <br /> Section 5, SCOPE OF SERVICES, shall be amended to add the <br /> following: <br /> <br /> "Company's duty to perform shall be deemed to include, <br /> but not be limited to, the provision for a Processing <br /> Facility, as required by the Agreement between the company <br /> and the South Bayside Transfer Station Authority dated <br /> June 22, 1982, as amended, and the operation of a Processing <br /> Facility, vehicles, equipment and personnel substantially as <br /> set forth in the Proposal dated August 10, 1992, <br /> (transmitted by letter dated August 20, 1992, collectively, <br /> Exhibit "A", incorporated herein) and BFI's response of <br /> September 6, 1991, to JPA Letter dated August 23, 1991. <br /> (Exhibit "B" hereto which is incorporated herein.)" <br /> <br /> 3.
