landfill or transformation facilities by December 31, 1998 and to maintain or <br /> increase this level of diversion throughout the term of this Agreement and any <br /> extension periods. This indemnification is based on State regulations existing on <br /> September 1, 1996, and on the reasonableness of the waste composition analysis <br /> reported in the Agency's Source Reductions and Recycling Element which lead <br /> to the assumed diversion rate presented above. Should these regulations be <br /> amended, then BFI's indemnification extends only to the extent that, but not less <br /> than the extent that, the source reduction and recycling goals contained in the <br /> regulations in effect on September 1, 1996, are not met. <br /> <br />10 8.4 Insurance <br />11 Agency does not, and shal! not, waive any rights against Company which it may <br />12 have by reason of the aforesaid hold har~¥dess agreements, because of acceptance <br />13 by Agency or the deposit with Agency .by Company of the insurance policies <br />14 described in this provision. <br />15 A. Minimum Scope of Insurance. Coverage shall be at least as broad as: <br />16 1) The most recent editions of Insurance Services Office form number GL <br />17 0002 covering Comprehensive General Liability and Insurance Services <br />18 Office form number GL 0404 covering Broad Form Comprehensive <br />19 General Liability; or Insurance Services Office Commercial General <br />20 Liability coverage ("occurrence" fom-~ CG 0001). <br />21 2) The most recent editions of Insurance Services Office form number CA <br />22 0001 covering Automobile Liability, code 1 "any auto" and endorsement <br />23 CA 0025. <br />24 3) Workers' Compensation insurance as required by the Labor Code of the <br />25 State of California and Employers Liability insurance. <br />26 B. Minimum Limits of Insurance. Company shall maintain in force for the tem~ <br />27 of this Agreement limits no less than: <br />28 1) Comprehensive General Liability: Five Million Dollars ($5,000,000) combined <br />29 single limit per occurrence for bodily injury, Personal injury and property <br />30 damage. <br />31 2) Automobile Liability: Five Million Dollars ($5,000,000) combined single limit <br />32 per accident for bodily injury and property damage. <br />33 3) Workers' Compensation and Employers Liability: Workers' compensation <br />34 limits as required by the Labor Code of the State of California and <br />35 Employers Liability limits of $1,000,000 per accident. <br /> <br /> Page44 8/2/96 <br /> <br /> <br />
