! C. Deductibles and Self-Insured Retention. Any deductibles or self-insured <br />2 retentions must be declared to and approved by Agency. At the option of <br />3 Agency, either: the insurer shall reduce or eliminate such deductibles or self- <br />4 insured retention's as respects Agency, its officials, employees and agents; or <br />5 Company shall procure a bond guaranteeing payment of losses and related <br />6 investigations, claim administration and defense expenses. <br />7 D. Other Insurance Provisions. The policies are to contain, or be endorsed to <br />8 contain, the following provisions: <br />9 1) General Liability and Automobile Liability Coverages <br />10 a) Agency, its elective Council and appointive boards, commissions, <br />11 officials, employees, agents and volunteers are to be named as <br />12 additional insureds as respects: liability arising out of activities <br />13 performed by or on behalf of Company; products and completed <br />14 operations of Company; premises owned, leased or used by Company; <br />15 or vehicles owned, leased, hired or borrowed by Company. The <br />16 coverage shall contain no special limitations on the scope of protection <br />17 afforded to Agency, its elective and appointive boards, commissions, <br />18 officials, employees, agents or volunteers. <br />19 b) Company's insurance coverage shall be primary insurance as respects <br />20 Agency, its elective Council and appointive boards, commissions, <br />21 officials, employees, agents and volunteers. Any insurance or self- <br />22 insurance maintained by Agency, its officials, elective and appointive <br />23 boards, commissions, employees, agents or volunteers shall be excess <br />24 of Company's insurance and shall not contribute with it. <br />25 c) Any failure to comply with reporting provisions of the policies shall <br />26 not affect coverage provided to Agency, its officials, elective Council <br />27 and appointive boards, commissions, employees, agents or volunteers. <br />28 d) Coverage shall state that Company's insurance shall apply separately <br />29 to each insured against whom claim is made or suit is brought, except <br />30 with respect to the limits of the insurer's liability. <br />31 2) Workers' Compensation and Employers Liability Coverage The insurer <br />32 shall agree to waive all rights of subrogation against Agency, its officials, <br />33 elective and appointive boards, commissions, employees, agents and <br />34 volunteers for losses arising from work performed by Company for <br />35 Agency. <br />36 3) All Coverages--Each insurance policy required by this clause shall be <br />37 endorsed to state that coverage shall not be suspended, voided, canceled <br /> <br /> Page 45 8/2/96 <br /> <br /> <br />
