1 RECITALS <br />2 This Agreement (Agreement) is entere~l into this __ day of <br />3 , by and between the City of Redwood City, a municipal corporation (Agency), <br />4 and Browning-Ferris Industries of California, Inc., a California corporation (Company), <br />5 for the collection, processing, and marketing of green waste, and for the performance of <br />6 other services related to meeting the goals and requirements of the California Integrated <br />7 Waste Management Act. <br />8 Recitals <br />9 WHEREAS, Agency is a member agency of the South Bayside Transfer Station <br />10 Authority ("Authority"), a public entity formed by agreement in 1981 under the <br />11 California Joint Exercise of Powers Act (California Government Code §6500 et. seq3; <br />12 and, <br />13 WHEREAS, Agency and other member agencies of Authority have granted to <br />14 Company by separate agreements the right to Collect and remove Solid Waste and <br />15 Recyclable Materials generated within their respective territories, which separate <br />16 agreements have been adapted from the Uniform Franchise Agreement developed by <br />17 Authority for such purposes; and, <br />18 WHEREAS, Agency's current Agreements with the Company will expire on <br />19 September 30, 1999 unless extended as provided therein; and, <br />20 WHEREAS, Authority and Company have developed a Uniform Green Waste <br />21 Agreement for the Collection of Green Waste in order to achieve efficiencies and <br />22 economies in providing such services to the residents of the respective jurisdictions of <br />23 the member agencies of Authority; and, <br />24 WHEREAS, the Legislature of the State of California, by enactment of the <br />25 California Integrated Waste Management Act of 1989 (AB 939), has declared that it is <br />26 within the public interest to authorize and require local agencies to make adequate <br />27 provisions for solid waste handling within their jurisdictions; and, <br />28 WHEREAS, pursuant to California Public Resources Code §40059(a)(1), the <br />29 Agency has determined that an Agreement be awarded to a qualified company for the <br />30 Collection, processing, and marketing of Green Waste, and the performance of other <br />31 services related to meeting the diversion goal of fifty percent (50%) by the year 2000, <br />32 and other requirements of the California Integrated Waste Management Act; and, <br /> <br /> Page 1 8/2/96 <br /> <br /> <br />
