6.1.D. - Page 2 <br /> The apparent low bidder, Nicole's Work, failed to acknowledge addendum number one <br /> because of a fax-system error. They subsequently provided clarification of the events <br /> that resulted in their failure to acknowledge the addendum and confirmed that the <br /> addendum had no substantive effect on their bid. After review, staff accepted their <br /> explanation and notified both the low bidder and the second low bidder that the City was <br /> planning to exercise its discretionary prerogative to award the contract to Nicole's Work. <br /> Based on communications with both contractors, staff does not anticipate a bid protest. <br /> The difference between the Architect's estimate and the low bid is attributed to the <br /> architect underestimating the cost of fabricating and installing steel baffles for the <br /> ceilings and walls and not including the cost for lead abatement. Based on the bids <br /> received, staff believes that the bids are competitive and recommends awarding the <br /> project to Nicole's Works, Inc. If awarded, the work is scheduled to begin in February <br /> and be completed by April 2013. <br /> ALTERNATIVES <br /> Council may choose not to award the proposed contract and direct staff to re-advertise <br /> the project. <br /> FISCAL IMPACT <br /> Funds for this project have been approved and appropriated in the Fiscal Years <br /> 2011/2012 and 2012/13 budget as Capital Projects Fund — Police Range Upgrades, <br /> which has an available balance of $169,929 as of November 5, 2013.
