6.1.D. - Page 2 The apparent low bidder, Nicole's Work, failed to acknowledge addendum number one because of a fax-system error. They subsequently provided clarification of the events that resulted in their failure to acknowledge the addendum and confirmed that the addendum had no substantive effect on their bid. After review, staff accepted their explanation and notified both the low bidder and the second low bidder that the City was planning to exercise its discretionary prerogative to award the contract to Nicole's Work. Based on communications with both contractors, staff does not anticipate a bid protest. The difference between the Architect's estimate and the low bid is attributed to the architect underestimating the cost of fabricating and installing steel baffles for the ceilings and walls and not including the cost for lead abatement. Based on the bids received, staff believes that the bids are competitive and recommends awarding the project to Nicole's Works, Inc. If awarded, the work is scheduled to begin in February and be completed by April 2013. ALTERNATIVES Council may choose not to award the proposed contract and direct staff to re-advertise the project. FISCAL IMPACT Funds for this project have been approved and appropriated in the Fiscal Years 2011/2012 and 2012/13 budget as Capital Projects Fund — Police Range Upgrades, which has an available balance of $169,929 as of November 5, 2013. The funding requirement to complete this project requires an additional $35,000 and staff will prepare an inter-fund transfer from Capital Project Fund contingency funds to supplement the current balance. ENVIRONMENTAL REVIEW The proposed project is considered categorically exempt from the requirements of the California Environmental Quality Act Guidelines pursuant to Section 15301, Class 1 (d) "Restoration or rehabilitation of deteriorated or damaged structures." � �� BRIAN LEE, PE CFM.
