6.2.D. - Page 7 <br /> attachec! sct�edule of #�ome improvements, attacheef hereto as Exhibit "C and <br /> incarpara#ed herein by reference." <br /> c) Owner shall allow reasonable periodic examinatians, by prior <br /> appointment, of the interior and exterior of the Historic Property by <br /> representatives of the County Assessor for tf�e County of San Mateo, the <br /> Caiifornia De�artment of Parks and Recreation, the California Baard of <br /> Equalization, the Historic Resources Ad�isary Committee and City, as may be <br /> necessary to determine owner's compliance with the terms and provisions of this <br /> Contract, but in any event, there sh�all be af least one inspectio� annually by one <br /> or more r�presenfati�es of the City and the Historic Reso�rces Advisory <br /> Committee. <br /> d} Owner or agent of Owr�er shall provide written notice of the contract <br /> to the Office of Historic Preser�ation within six (6) months of entering into this <br /> Contract. <br /> 5. Pro�ision of Requested Information. Owner hereby agrees to furnish City <br /> with any and all information requested by the City which may be necessary or advisable <br /> to determine compliar�ce wit� the terms and provisions of this Contract. <br /> 6. Canceliation for Breach. City, foliawing a cluly noticed public hearing <br /> pursuanf ta California Go�ernment Code Sectians 5D2$p, et. seq,, may cancel tl�is <br /> Contracf if it defermines that Owner breached any afi the conditions a# this Co�tract ar <br /> has al�owed the p�operty to deteriorate to the point fhat Et no longer meets the standards <br /> for a qualified historic property. City may also cancel this Contract if it determines that <br /> the Owner F�as failed to restore or rehabilitate the property in the manner specified in <br /> subparagraph 4(b) of this Contract. In the event af cancellation, Owner may be subject <br /> to payment of those cancellatian fees set forth in California Goverr�ment Code Sections <br /> 50280, et. seq. <br /> 7. Enforcement of Contracf. As an alternafive #o cancellation of the Contract <br /> for breach of any condition, City may specifically enforce, ar enjoin the breach of, the <br /> terms of this Contract. In the avent of a default under the provisions of this Contract by <br /> Owner, City shal! give written notice to Owner by registered or certified mail ac{dressed <br /> to the address stated in this Contract, and if such a �iofation is not corrected ta the <br /> reasonable satisfaction af the City within thirty {30) days thereafter, or if not corrected <br /> within such reasonable tim� as may be required to cur� the E�reach or default if said <br /> breach of default cannot be cured within thirty (30) days {provided that acts to cure the <br /> breach or default must be commenced wifihin thir�y (30) days and must thereafter be <br /> diliger�tly pursued to completion by Owner), then City may, without further natice, <br /> declare a detault under the terms of this Contract and may bring any action necessary <br /> to specificalfy enforce the abligations af 4wner growing out vf the terms o�this CQntract, <br /> apply to any caurt, state or federal, for injunctive relief against any �iolation by Owner or <br /> apply for such other relief as may be appropriate. <br /> A77YIAGW2412.1841FOX THEA7RE MILLS ACT CONTRACT <br /> REV: 11-15-12 VFt <br /> Page 3 of 10 <br />
