I <br /> <br /> §203 City_ Transfer Parcel and City-Retained Parcel <br /> <br /> The City currently owns that portion of Block Two shown on Attachment 5 and more <br />particularly described as Assessor's Parcel Number 052-363-170. Agency, City and Developer <br />agree that fee title to a portion of such land currently owned by the City, designated on <br />Attachment No. 5 as the "City-Transfer Parcel" and containing approximately 16,000 square feet, <br />shall be conveyed to Developer (either directly from the City to Developer or by means ora <br />conveyance by the City to the Agency and then by the Agency to Developer) and consolidated <br />with Parcels G and H (as defined in Section 204) to create a new parcel containing a total of <br />approximately 32,000 square feet, which new parcel is designated on Attachment No. 5 and is <br />herein referred to as the "Office Building Parcel." Following conveyance of the City Transfer <br />Parcel to Developer, the City shall continue to own fee title to the remaining portion of Block <br />Two, which remaining land is designated on Attachment 5 and is herein referred to as the "City- <br />Retained Parcel". City and Agency agree that they shall, in accordance with the Schedule of <br />Performance, take such action as may be required to apply for and process the subdivision of the <br />Block Two land currently owned by the City consistent with the foregoing provisions of this <br />Section 203, and City and Agency shall cooperate with Developer to obtain the approval 0fa <br />final subdivision map for Block Two whereby Block Two will be divided into two legal parcels <br />constituting the City-Retained Parcel and the Office Building Parcel. <br /> <br /> §204 Acquisition Parcels: Parcels A. B. C. D. E. F. G and H <br /> <br /> In addition to the Agency Parcel covered under Section 202 above and the City-Transfer <br />and City-Retained Parcels covered under Section 203 above, there are the following eight (8) <br />other parcels that comprise the Project Site (the "Acquisition Parcels"): <br /> <br /> Letter Prelimina~. Agency Parcel and City-Transfer Parcel <br /> <br /> Title to and right of possession of the A~quisition, Agency and City-Transfer Parcels will <br />be conveyed to the Developer, in their as-is condition, in accordance with Article 3 of this <br />Agreement.
