"which amends the agree~...~nt

Task Order Number 3

Subsequent to completion of the DEIR and FEIR, an appeal of the Planning Commission's
certification of the FEIR was filed on October 25, 2000. This action necessitated further
work for the EIR consultant team, focused on the issues of traffic and parking as well as
economic and market factors that have been observed in other cities and that could
influence the success of the project. Additionally, it was decided to hold three additional
public forums on the proposed project in order to allow for maximum public input. The
consultants prepared presentation materials and attended these meetings. This work was
outside of the original and amended scope of work.

Hence, an additional amendment to the original agreement, Task Order No. 3, in the
amount of $47,560 has been requested. The developer has agreed to fund this
amendment. (Please refer to attached copies of letters from consultant and to developer.)

Alternative
The environmental work has been done and, in the case of Task Order Number 2, funded.
Staff does not believe there to be any practical alternative to the recommended action.

Fiscal Impact
~'~ ,~' ~There is no impact on the AgencI. ~~ T,he developer~ paying the entire ~'.~h/~,~. _ _

Patricia J.
