iREPORT To the Honorable Mayor and City Council <br /> <br /> From the City Manager <br /> <br />February 9, 2004 <br /> <br />Subject <br />Agreement for Special Counsel Services <br /> <br />Recommendation <br />By Motion, authorize execution of an agreement for Special Counsel Services with Hanson <br />Bridgett Marcus Vlahos Rudy, LLP <br /> <br />Background <br />Beginning in July 2002, the Public Works Services Department, in collaboration with the <br />City Attorney's office, retained the San Francisco law firm Hanson Bridgett Marcus Vlahos <br />Rudy, LLP to assist staff with several environmental, regulatory and long-term water supply <br />planning activities for potable water supply and the potential use of recycled water for non- <br />potable applications. Mr. Ray McDevitt, a principal member of the firm, provided critical <br />services and advice on complex issues related to the City's Urban Water Management <br />Plan revision, implementation of SB610 "water supply assessment" procedures, and the <br />California Environmental Quality Act (CEQA) review and documentation of the recycled <br />water project. Mr. McDevitt's expertise in the legal, technical and regulatory aspects of <br />public water supplies and his acute knowledge of the regional water supply system have <br />proved invaluable to staff and have ensured that the Council's consideration of important <br />policy issues were framed fully and properly. <br /> <br />With the Community Task Force on Recycled Water scheduled to make its <br />recommendations to the City Council in March, there will be multiple, subsequent <br />implementation actions for the Council to consider, each requiring specialized legal <br />services. Additionally, with several large new developments working their way through the <br />city's approval process, staff will require services to craft various legal documents that the <br />Council will rely on in part to make water supply findings and land use decisions. Some <br />examples of services and/or work products anticipated: <br /> · Revision of the city's water connection / capacity fees ordinance <br /> · Review of California SB2095 "Dual plumbing" law and creation of a city ordinance <br /> · Draft and process a Recycled water supply/capacity agreement with South Bayside <br /> System Authority <br /> Provide advice and input as required by staff to respond to City Council direction <br /> and policy decisions about water supply and recycled water <br /> · Compile the city's first SB221"Water Verification" document for the proposed Marina <br /> Shores Village development <br /> · Development of recycled water service agreement forms and procedures (to <br /> facilitate city offers to property owners for conversion of irrigation meters from Hetch <br /> Hetchy drinking water to recycled water) <br /> · Legal review of draft recycled water project Engineer's Report / permit application to <br /> the Regional Water Quality Control Board and California Dept. of Health Services. <br /> <br /> <br />
