The following constitutes the Council's findings.
A. The City of Redwood City has the responsibility of managing the
maintenance of all sidewalks, roads, streets and rights-of-way in the
City to preserve the operational safety, integrity, and function of the
City's transportation system; and
B. The manner in which utilities and other encroachments cross or
otherwise occupy City roads and streets can materially affect the safe
operation, maintenance, and longevity of the streets; and
C. It is necessary to protect the safety of the driving public, that the use,
occupancy and all encroachments of City streets be subject to City
authorization and reasonably regulated; and
D. The ordinance herein has been generated in the interest of developing
and preserving safe streets and minimizing possible interference and
impairment to the roadway, its structures, lifespan, appearance,
operation and maintenance; and
E. It is in the public interest for utility facilities and other encroachments to
be accommodated within the right-of-way of City streets, when such
use and occupancy does not interfere with the free and safe flow of
traffic or otherwise impair the roadway or its safety, longevity, and
scenic appearance, and does not conflict with the provisions of
Federal, State or Local Laws or this accommodation ordinance.
SECTION 2. Chapter 29 STREETS, SIDEWALKS AND DRIVEWAYS, is
hereby repealed in its entirety.
SECTION 3. [The following table of contents and the highlighted text
designating a section new, similar or same are informational only and are not
part of the ordinance.]] A new Chapter 29, "STREETS, SIDEWALKS and WORK
IN OR USE OF CITY RIGHT-OF-WAY" is hereby added to read as follows:
ATTY/ORD.377/AMENDING CHAPTER 29 STREETS, SIDEWALKS AND DRIVEWAYS
REV: 11-16-12 JS
