6.4.A. - Page 3 <br /> complete or repair the permittee's work; and, (v) For work which cuts or damages street <br /> pavement, an optional pavement damage restoration fee, as explained above. <br /> The requirements for sidewalk and driveway repairs and work remain basically the <br /> same as in the current chapter, however, maintenance and repair of the sidewalk is <br /> clarified to be the responsibility of the adjacent property owner. <br /> A new section adopting penalties for violation of this chapter is included at the end of <br /> the chapter. The penalties for violating any provision of this chapter or an encroachment <br /> permit may be: (i) A misdemeanor criminal citation; (ii) A civil penalty up to $1000 per <br /> day per violation; (iii) An Administrative penalty up to $1000 per day per violation and/or <br /> restitution for or repair of damages. A violator may not be required to pay both a civil <br /> penalty and an administrative penalty. The City may also file an action in court to obtain <br /> an injunction or other equitable relief. <br /> ALTERNATIVES <br /> 1. The City Council could choose not to take any action and require staff to work <br /> with the current code provisions. <br /> 2. The City Council could direct staff to make other changes to the proposed <br /> ordinance. <br /> FISCAL IMPACT <br /> This ordinance may save the City expenses for street repairs necessitated by poorly <br /> performed or unauthorized work in City streets. <br /> ENVIRONMENTAL REVIEW <br /> This ordinance is not a "project" within the meaning of the California Environmental <br /> Quality Act.
