6.1.D. - Page 10 <br /> DECLARATION OF ANNEXATION <br /> FOR <br /> ONE MARINA, <br /> A CONDOMINIUM PROJECT <br /> PHASE 4 <br /> THIS DECLARATION OF ANNEXATION for One Marina, a Condominium Project, <br /> Phase 4 (the "Declaration of Annexation") is made on the date hereinafter set forth by the <br /> undersigned (the"Declarant")and is made with speci�c reference to the following facts: <br /> A. Declarant is the owner of portions of that certain tract of land located in the City <br /> of Redwood City, County of San Mateo, State of California (the "Property") which is shown and <br /> described on that certain subdivision map entitled Parcel Map No. 2011-02 (the "Parcel Map") <br /> which was recorded on June 27"', 2011, in Book 79 of Parcel Maps, at Pages 90 through 92, <br /> inclusive, in the Official Records of the County of San Mateo, State of California (the "Official <br /> Records"). Portions of the Property have been developed into a Common Interest Development <br /> which is a condominium project as defined in California Civil Code Section 1351(fl. <br /> B. Parcel 3 shown on the Parcel Map has been further subdivided for condominium <br /> purposes by that certain condominium map entitled "Final Map, One Marina Unit Two, for <br /> Condominium Purposes" (the "Condominium Map") which was recorded on , <br /> 20_, in Book of Maps, at Pages through , inclusive, in the Official Records. <br /> One of the new lots created by the Condominium Map is designated as "Lot 3A" on the <br /> Condominium Map. It is a portion of Lot 3A shown on the Condominium Map that is the subject <br /> of this Declaration of Annexation, which portion of Lot 3A is shown on the Cunent Phase <br /> Condominium Plan described below. Other parcels shown on the Parcel Map may also be further <br /> subdivided for condominium purposes by the recordation of condominium maps. <br /> C. Declarant executed the Declaration of Covenants, Conditions and Restrictions <br /> Establishing a Plan for Condominium Ownership of One Marina (the "Declaration") which was <br /> recorded on January 13, 2012, as Instrument No. 2012-005179, in the Official Records, as <br /> amended by the First Amendment of Declaration of Covenants, Conditions and Restrictions <br /> Establishing a Plan for Condominium Ownership of One Marina (the "CC&Rs Amendment"), <br /> which was recorded on November 29, 2012, as Instrument No. 2012-177982, in the Of�cial <br /> Records. <br /> D. Declarant executed the Condominium Plan, One Marina-Phase 4, which was <br /> recorded on , 20_, as Instrument No. in the <br /> Official Records (the "Current Phase Condominium Plan"). The Cunent Phase Condominium <br /> Plan pertains to and describes a portion of Lot 3A as shown on the Condominium Map, and shows <br /> and describes the Condominium Units and Common Area in Phase 4 of the Development. <br /> E. Section 2.8 of the Declaration provides that Declarant may annex into the <br /> Development described in the Declaration additional Phase(s), and thereby make such Phase(s) <br /> subject to the Declaration.
