6.1.D. - Page 11 <br /> NOW,THEREFORE, DECLARANT HEREBY DECLARES AS FOLLOWS: <br /> 1. Definitions. The capitalized terms in this Declaration of Annexation shall have <br /> the same meanings given them in the Declaration unless this Declaration of Annexation provides <br /> otherwise. <br /> 2. Annexation. Pursuant to the terms of the Declaration, Declarant, as owner of the <br /> real property in Phase 4, declares that: <br /> (a) Buildin s : Building 6 and Building 8, as shown on the Cunent Phase <br /> Condominium Plan and defined in the Declaration; <br /> (b) Buildin� Common Area: The designated Building Common Area for <br /> Building 6, and the designated Building Common Area for Building 8, as shown on the Current <br /> Phase Condominium Plan and defined in the Declaration; <br /> (c) Units: Units 601 through 603, Units 605 through 613, and Units 615 <br /> through 618, all located in Building 6 as shown on the Current Phase Condominium Plan and <br /> defined in the Declaration;and <br /> (d) Units: Units 801 through 803, Units 805 through 813, and Units 815 <br /> through 818, all located in Building 8 as shown on the Current Phase Condominium Plan and <br /> defined in the Declaration;and <br /> (e) Association Common Area: Subject to subsection 2(fl below, the <br /> Association Common Area as shown on the Cunent Phase Condominium Plan and defined in the <br /> Declaration; <br /> as such Buildings, Building Common Area, Units and Association Common Area are shown and <br /> described on the Current Phase Condominium Plan, are hereby annexed to and made a part of the <br /> Development described in the Declaration. Upon the conveyance of title to a Condominium in <br /> the annexed property or the commencement of assessments for Condominiums in the annexed <br /> property, whichever occurs first, the annexed property shall be held, sold, leased, transferred, <br /> occupied, and conveyed subject to the terms, provisions, covenants, conditions, restrictions, and <br /> easements of the Declaration and its amendments as if the annexed property were originally <br /> subject to the Declaration. <br /> (f) Notwithstanding the foregoing, certain portions of the Association <br /> Common Area shall be temporarily retained by Declarant and transfened to the Association in <br /> connection with a future Phase of the Development, as described in Section 6 of this Declaration <br /> of Annexation, and as further described in the "Declaration of Reciprocal Access Easement and <br /> Use and Maintenance Agreement (Association Common Area)," which was recorded on January <br /> 13, 2012, as Instrument No. 2012-005181 in the Official Records (the "REA"), and any <br /> amendments, modifications or supplements thereto. <br /> 3. Interests. The owner of a Condominium will receive a separate interest in a Unit <br /> and an equal undivided percentage interest in common in the Building Common Area of the <br /> Condominium Building in which that Unit is located, as described in the Declaration.
