MiG 7.A. - Page 201 <br /> City of Redwood City EIR Addendum <br /> October 8,2012 Page 3-38 <br /> of intertidal wetland along Redwood Creek and Smith Slough sufficient to support incidental <br /> foraging by the California clapper rail, a federal- and state-listed endangered species. <br /> Similar to the mitigation for Impact 8-1, the associated 2003 EIR mitigation required coordination <br /> with the United States Fish and Wildlife Service (USFWS) and CDFG on clapper rail issues and <br /> associated implementation of an HMMP subject to approval by these agencies. <br /> The current Pete's Harbor project would not fill any existing intertidal wetland. However, the <br /> project would include construction adjacent to the intertidal wetland along Redwood Creek and <br /> Smith Slough to accommodate public access and landscaping (see Figure 3.5-1 and figures in <br /> chapter 2 of this Addendum). The potential for impacts of construction directly adjacent to <br /> intertidal wetland (e.g., noise, contaminant release) would remain. <br /> Conclusion. Modified impact. The impact has been modified to remove the reference to <br /> "direct long-term loss of intertidal wetland" because this particular situation would not occur <br /> under the current Pete's Harbor project. The mitigation identified in the 2003 EIR for Impact 8-3 <br /> remains applicable to the current Pete's Harbor project and remains sufficient to reduce the <br /> impact to a less-than-significant level. As stated in the mitigation, if the required breeding <br /> surveys (subject to USFWS and CDFG approval) conclude to jurisdictional agency satisfaction <br /> that the distance of any identified clapper rail territory from project construction activity <br /> represents a suitable buffer, no further action regarding the clapper rail would be required. <br /> Impact 8-4 Analysis: General Construction Noise Impacts on Wildlife. The certified 2003 <br /> EIR indicated that existing foraging and reproductive activities of wildlife in the adjacent <br /> sensitive habitat areas (e.g., Bair Island Wildlife Refuge), including habitat of special-status <br /> species, could be disrupted by project construction activity and noise. Affected special-status <br /> species could include: California clapper rail, California least tern, Western snowy plover, <br /> California black rail, northern harrier, short-eared owl, saltmarsh common yellowthroat, and <br /> Alameda song sparrow. <br /> The associated 2003 EIR mitigation described mitigation similar to that for Impact 8-1, including <br /> coordination with the USFWS and CDFG on the issue, completion of jurisdictional agency- <br /> required special-status species surveys, and implementation of an associated USFWS- and <br /> CDFG-approved HMMP. <br /> Pete's Harbor project construction activities could disrupt Redwood Creek and Smith Slough <br /> estuarine habitat and other adjacent sensitive habitat areas (e.g., Bair Island Wildlife Refuge) for <br /> one or more of these species. <br /> Conclusion. No change. The mitigation identified in the 2003 EIR for Impact 8-4 remains <br /> applicable to the current Pete's Harbor project and remains sufficient to reduce this impact to a <br /> less-than-significant level. As stated in the mitigation, if the required breeding surveys (subject <br /> to USFWS and CDFG approval) conclude to jurisdictional agency satisfaction that the distance <br /> of any identified special-status species territory from project construction activity represents a <br /> suitable buffer, no further action regarding the identified species would be required. <br /> Impact 8-5 Analysis: Project-Related Loss of Estuarine Navigable Waters and Other <br /> Waters of the U.S. The certified 2003 EIR indicated that the project would fill approximately <br /> 11.54 acres of waters under the jurisdiction of the Army Corps of Engineers (Corps) (also see <br /> Impact 8-1).
