However, because project building heights would still have <br /> exceeded 75 feet, the impact was considered significant and unavoidable. <br /> Under the current Pete's Harbor project, the proposed maximum height of buildings would be <br /> reduced to 75 feet. <br /> Conclusion. Modified impact and mitigation. The mitigation identified in the 2003 EIR for <br /> Impact 8-8 remains applicable to the current Pete's Harbor project. In addition, if all project <br /> buildings would be below the City-adopted 75-foot height limit, including those under <br /> construction for One Marina, which was formerly the Peninsula Marina component of the Marina <br /> Shores Village EIR. Therefore, the mitigation (lighting policy with minimal exterior lighting, low- <br /> intensity exterior lighting, cut-off/shielded lights, automatically timed perimeter lights) would <br /> reduce the impact to a less-than-significant level. <br /> Impact 8-9 Analysis: Project-Related General Outdoor Lighting Impacts on Biological <br /> Resources. The certified 2003 EIR identified an impact on biological resources (e.g., birds) <br /> resulting from project outdoor lighting features located at a close distance to sensitive wetland <br /> habitats (e.g., the marina area, Redwood Creek, Smith Slough). The associated mitigation was <br /> the same as that for Impact 8-8 above. <br /> Conclusion. No change. The current project, by not including the Peninsula Marina (One <br /> Marina) component currently under construction, would reduce the amount of marina, Redwood <br /> Creek, and Smith Slough estuarine habitat directly affected. However, outdoor lighting impacts <br /> on these sensitive estuarine wildlife habitats (and associated bird and other animal and plant <br /> species) within the marina/Redwood CreeWSmith Slough estuarine areas still affected by the <br /> project would remain potentially significant. The mitigation identified in the 2003 EIR for Impact <br /> 8-9 therefore remains applicable to the current Pete's Harbor project and remains sufficient to <br /> reduce this impact to a less-than-significant level. <br /> Impact 8-10 Analysis: Project-Related Introduction of Invasive, Non-Native Plants. The <br /> certified 2003 EIR indicated that, since the project site (in particular, the Pete's Harbor property) <br /> was adjacent to the Bair Island National Wildlife Refuge, a federally managed wildlife reserve, <br /> invasive non-native plant species could have an adverse effect on native vegetation and <br /> special-status wildlife in the area. The associated 2003 EIR mitigation required eliminating eight <br /> invasive, non-native species listed on the project landscape plan that would have the potential <br /> to invade and displace native plants, with additions/substitutions subject to approval by the City. <br /> The current Pete's Harbor project site is near the Bair Island National Wildlife Refuge, although <br /> the Peninsula Marina (One Marina) property is no longer part of the project site (see Figure <br /> 3.5-1). <br /> Conclusion. Modified impact and mitigation. The current project would be located near the <br /> Bair Island Wildlife Refuge. Impact and Mitigation 8-10 identified in the 2003 EIR have been <br /> modified to apply directly to the current Pete's Harbor proposal, and to indicate that City staff <br /> and the applicant have been collaborating on selection of the project's plant palette. The <br /> mitigation remains sufficient to reduce this impact to a less-than-significant level. <br /> Other Impacts.
