City a�d Developer desire to entej• ata agreement pravidi�tg foz� the const�uction and <br /> installatian of the I�nprovements in accordance with the Improvement P1ans. <br /> AGREEMENT <br /> NOW,TI�REFORE, iu considei•ation of the faithful performa�ice of t�e te�•nras and conditions set <br /> forth in this Agreement,the pa�•ties hereto agree as follows: <br /> 1. Purpose. The purpose of this Agreement is to guarantee completion of tl�e Imp�•ovements <br /> ar�d ens��•e satisfactory pe��fo��nanee by Developer of Develope�•'s obligations to satisfy the Conditions <br /> pertaining to the Improvements. <br /> 2. Propei�t,�ject to Agi•eem�ttt. The Praperty shatl be subject to this Agt•eement, <br /> 3. DutXto Install Improverr�ents. Develope�•will eonstruct, install and complete, or cause to <br /> be constructed, installed a�d campleted, at the Developer's sale cost and expense, the Improvements, in <br /> accordance with the Improvement Plans (defined in Recital E. abava} and to the sa�isfaction of tlie City <br /> Engineer, in his reasonable discretion. Develaper will also supply a11 labor and materials therefar, all in <br /> strict accordance with the tex•tns and conditions of this Agr�ement.
