Authorize the City Manager to execute agreements, approve payments and take <br /> all other necessary actions associated with the management and maintenance of the <br /> Docktown Marina in an amount not to exceed $250,000. <br /> 2. Approve the Form Berthing Agreement (Attachment 1) and authorize the City <br /> Manager to execute Berthing Agreements in substantially the same form as the Form <br /> Berthing Agreement, subject to revisions deemed by the City Attorney as necessary or <br /> beneficial to protect the City's interests, with Qualified Tenants. <br /> 3. Adopt the Resolution (Attachment 2) approving an appropriation in the amount of <br /> $50,000 within the Redwood City Capital Outlay Fund for the Docktown Marina <br /> Management project. <br /> 4. Waive First Reading and Introduce an Ordinance (Attachment 3) Amending <br /> Chapter 2, Article IV, Section 2.37 to Establish an Enterprise Fund for the Operations <br /> and Maintenance of the Docktown Marina. <br /> 5. Authorize the City Manager to negotiate and execute a license agreement with <br /> the landowners of Docktown Marina in an amount to be determined and a term not to <br /> exceed three years. <br /> BACKGROUND <br /> Redwood City acquired its interest in the portion of Redwood Creek that is now the <br /> Docktown Marina from the state in 1954. In 1964, the City leased the waterway for use <br /> as a marina and it has been operated as such since then. The current operator, <br /> Docktown Marina, Inc., has a lease agreement with the land-side owners and a <br /> revocable permit with the City to operate the marina and a variety of other uses. In <br /> December 2012, Fred Earnhardt, Jr., the owner of the business, advised the land <br /> owners that he was terminating his lease with them and would leave within 30 days. <br /> The land owners and City staff inet with Mr. Earnhardt to extend his time of departure; <br /> this was successful and he will remain on site until the end of February 2013.
