8.A. - Page 3 <br /> sewage pumping for individual units), a capital reserve, and an evaluation of <br /> comparable slip fees in the Bay Area to establish appropriate slip and lease fees. Each <br /> vessel that wishes to remain in the marina must apply for a slip and meet the minimum <br /> requirements established in that agreement. Staff reviewed agreements throughout the <br /> Bay Area and believes the conditions for berthing as proposed in the City's agreement <br /> are consistent with industry standards. <br /> There remains a need for landside support for the marina. Consequently, the <br /> landowners and City are negotiating a license agreement to enable this need. <br /> Specifically, there remains a need for access to the marina, parking, and utilities, all of <br /> which require crossing and use of the land. Additionally, there are three buildings that <br /> support the marina operations: Peninsula Yacht Club, the harbor offices, and showers <br /> and laundry facilities. Details for all of these facilities and uses are being resolved, but <br /> negotiations are not complete, and may not be finalized until after March 1. Staff and <br /> the landowners will work to assure there is no break in access for the water tenants <br /> while the final details are resolved. The license agreement will be for an initial term <br /> which will not exceed an amount up to $60,000 unless and until the Council approves <br /> the final agreement, at which time the term will automatically extend to the fully <br /> negotiated term. The final agreement will be brought to the Council for its consideration <br /> at the earliest moment. <br /> The City through its Revocable Permit received $1,700 monthly from the Marina <br /> operators. Moving forward the Marina operations are not intended to have any adverse <br /> impacts on the General Fund. However, until all costs and revenues are fully <br /> understood, it may be that the newly created fund initially does not pass this minimal <br /> payment to the General Fund. <br /> Staff believes the initial effort to establish an accurate rental roll, determine vessel <br /> worthiness, and create a facilities management plan will take approximately six months. <br /> During this same period staff will continue to work to bring in a longer-term management <br /> team, who would likely be in place for a two year period, while the Inner Harbor Plan is <br /> developed. The Inner Harbor Planning process will take approximately one year to work <br /> through the public planning and environmental impact report preparation. <br /> Consequently, there is likely no development in the area that would affect the Docktown <br /> Marina for at least this period. Once the planning process is complete, it is also likely to <br /> be at least another year before a development proposal would be created, submitted, <br /> approved, and begun in such a manner that there would be an impact on the marina <br /> operations. Once the Inner Harbor planning effort is complete, staff anticipates returning <br /> to the Council with recommendations for modifying the Docktown Marina management <br /> and operations to align with whatever the final Inner Harbor plans are. <br /> ALTERNATIVES <br /> The City Council may direct staff to solicit further proposals for the management of <br /> Docktown Marina, or modify the terms of the recommended agreement form. <br />
