ÅbØ <br />ólP d UJoód ~ <br /> <br />, California <br /> <br />, 20W <br /> <br />Deed No. û'S3 - 00 c¡- 0 ~3 <br /> <br />REAL PROPERTY PURCHASE CONTRACT <br /> <br />Document No. in the fonn of a Grant Deed has been executed and delivered to <br />Michael Church, Executive Director of The Redevelopment Agency of the City of Redwood City <br />("Agency"), by The Rosalee Davies Trust ("Grantor(s)"). <br /> <br />In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as <br />follows: <br /> <br />1. <br /> <br />2. <br /> <br />The Agency and Grantor(s) ("parties") have herein set forth the whole of their agreement. The <br />perfonnance of this agreement constitutes the entire consideration for said document and shall relieve <br />the Agency of all further obligations or claims on this account, or on account of the location, <br />implementation, construction or operation of the proposed public improvement except as otherwise <br />provided herein. <br /> <br />The Agency shall pay the sum of $2,125,000 for the property described as 1) 1502 S. El Camino <br />APN 053-093-130; 2) 1540 El Camino, APN 053-093-140; 3) 124 Lincoln Ave., APN 053-093-070; <br />4) 130 Lincoln Ave., APN 053-093-080, and which is the subject of Grant Deed herein to the <br />following title company: First American Title Company, 555 Marshall Street, Redwood City, <br />California, Escrow No. for the account of Grantor(s), conditioned upon the property vesting <br />in the Agency free and clear of all liens, leases, encumbrances, easements (recorded and/or <br />unrecorded), assessments and taxes, except taxes for the fiscal year in which this escrow closes shall <br />be prorated and paid at the close of escrow. Any current taxes that cannot be prorated and paid shall <br />be cleared and paid in the manner required by section 4986 of the Revenue and Taxation Code and/or <br />as hereinafter provided. <br /> <br />3. <br /> <br />Grantor(s) warrant that there are no oral or written leases on all or any portion of the property <br />exceeding a period of one month, and Grantor(s) further agree to hold the Agency harmless and <br />reimburse Agency for any and all of its losses and expenses occasioned by reason of any lease of <br />said property held by any tenant of grantor for a period exceeding one month, excepting therefrom <br />any expenses Agency incurs resulting from its obligations for relocation assistance benefits wmch <br />may arise by reason of Article 9 of Chapter 4 of Division 24 of the Health and Safety Code of the <br />State of California, or by reason of Chapter 16 of division 7 of Title I of the Government Code of the <br />State of California, or by reason of the federal act entitled "Unifonn Relocation Assistance and Real <br />Property Acquisition Policies Act of 1970" (Public Law 91-646), as amended, or by reason of any <br />law or regulation of the United States of America or the State of Califol11ia. <br /> <br />4. <br /> <br />Grantor(s) acknowledge and agree that Grantor(s) are not entitled to receive any compensation for <br />relocation, fixtures and equipment or goodwill and funher agree to execute quit claim deeds, if <br />appropriate, for any such property interests. <br /> <br />Grantor(s) acknowledge and agree that Agency has satisfied all legal requirements imposed by <br />Chapter 16 (commencing with Section 7260) of Division 7 of Title 1 of the Government Code with a <br />partic~lar reference to Section 7261, 7267.1 and 7267.2, and Grantor(s) agree to voluntarily and <br />kn~wmgly release and forever discharge Agency and its successors and assigned, from any and all <br />chums or dama~~s .for relocation assistance benefits which may arise by reason of Article 9 of <br />Chapter 4 of DIYl~l?n 24 of t~e Health and Safety Code of the State of California, or by reason of <br />Chapter 16 of diVISIon 7 of TItle I of the Government Code of the State of California, or by reason of <br />the f~~eral a~t entitled "Unifonn Relocation Assistance and Real Property Acquisition Policies Act of <br />1970 (PublIc Law 91-646), as amended, or by reason of any law orregulation ofthe United States of <br />America or the State of California. <br /> <br />5. <br /> <br />Page 1 of 3 <br />
