Pursuant tfl Section 1.54 of the City's Munici�al Code, Applicant <br /> shall defend, indemnify, and hald harrrtless the City, its agents, officers, and <br /> employees from any claim, action, or procee�ing against the City or its agents, <br /> offEC�rs or employees, including but not limited to �he Planning Commission, and <br /> the City's and Planning Commission's agents, officers or employees, from third <br /> party(ies) invol�ir�g or related to the City's consideration and or apprava� of <br /> Applicant's Expansion Project appfication. The C�ty shall prompfly notify <br /> Applicant of any such claim, ac�ion or praceeding and shall coflperate fiully in fhe <br /> defense. <br /> 39. No building or zor�ing permit shall be issued, and no use shall be <br /> established except in accordartce with and subject to the terms and conditions <br /> outlined abo�e, ar�d in no case shall such permit be issued or use established <br /> prior to the finaf action on any appeals that may be filed within the appeal pe�iod. <br /> Any appeaE made in accordance with the pro�isians of Section 48.2 of the Zoning <br /> Ordinance must be recei�ed by tf�e City Clerk no lat�r fhan fifteen ('f5) calendar <br /> days after the date of the official action.
