(a} The Legislature finds and dec[ares all of the faflowing: <br /> (�) The lack of housing, indudina emer�encv shelters, is a cri�icai pr�blem that threate�s the <br /> econamic, environmental, and social quality of life in California. {2) California housing has <br /> become the most expensi�e in the nation. Ti�e excessi�e cosf of the state's #�ousing suppiy is <br /> partially caused by activities and policies af many loca! governments that iimit the approval of <br /> housing, increase the cost of land for housing, an� require that high fees and exactions be <br /> paid by producers of housi�g. <br /> (3) Among the cansequer�ces of those actians are discrimination against law income and <br /> minority households, lack af housing ta support employment growth, imbalance in jobs and <br /> housing, reduced mobility, urban sprawl, excessive commuti�g, ar�d air quality deterioration. <br /> (4} Many local go�ernments do not gi�e adequa�e attention to the economic, en�ironmental, <br /> and sacial costs of decisions that resuEt in disapproval of housing prajects, reduction ir� <br /> density of housing projects, and excessi�e standards for hausing projects. <br /> {b) ft is the policy of the state that a lacaf go�ernment not reject or make ir�feasible housing <br /> develo�ments, includinq emerqencv shelters, that car�tribute to meeting the� need <br /> determined pursuant to this article without a thorough ana�ysis af the economic, social, and <br /> Environmental effects af�he action and without complying with subdi�ision (d}. <br /> (c) The Legislature also recognizes that premature and unnecessary de�elopment ofi <br /> agricultural lands for urban uses continues #o ha�e ad�erse effects on the availability of those <br /> lands for food and fiber production and on the econamy of the state. Furthermore, it is the <br /> palicy of the state �hat develapment should be guided away from prime agriculfural lands; <br /> therefore, in implementing this section, local jurisdictions should encourage, to the maximum <br /> extent pracficable, in filling existing urban areas. <br /> (d) A focal agency shal[ not disappro�e a housing devefapm�nt project, induding farmworker <br /> housing as defined in subdivision (d) of Section 50199.50 of the Health and Safety Code, for <br /> very low, low�, or moderate-incame households, or an emer enc shelter or candition <br /> appro�al in a manner that renders the project infeasibfe far development for the use of�ery <br /> low, fow-, ar moderate- incame hauseholds, or an emerqency shelt� including througt� the <br /> use of design re�iew standards, unless it makes written findings, based upon substantiai <br /> e�idence in the record, as to one of the fol[owing: <br /> (1} The j�arisdiction has adopted a housing element pursuant to this art�cl� that has been <br /> revised in accordance with Section 65588, is in substantial compliance with this article, ar�d <br /> the jurisdiction has met or exceeded its share af the regional housing need allocation <br /> pursuant to Sectior� 65584 for the planning periad far th� income category proposed for the <br /> housing development project, pravided that any disapprovai or canditional approval shall not <br /> be �ased an any of the reasans prohibited by 5ection 650D8. If the housir�g de�elopment <br /> project inc[udes a mix of income categories, and the jurisdiction has not met or exceeded its <br /> share of the regional housing need for one or more of thase categories, then this paragraph <br /> shall not be used to disapprove or conditianally approve the praj�ct.
