6.3.E. - Page 12 PUBLIC UTIL�TIES C4MMISSiQN <br /> City and County of San Francisco <br /> RESOLUTION NO. 13-OU22 <br /> WHEREAS, �n Resalution 09-0069 the Comrnission approved the Water Supply <br /> Agreement between the City arid Co�nty of San Francisco and WholesaIe Customers in Alameda <br /> County, San Mateo Courity and Santa Clara County ("Water Supply Agreement"); and <br /> W�REAS, an April 28, 2009, the Wholesale Customers approved th� Water Supply <br /> Agreement pursuant to Section 2.D3; and <br /> WI-iEREAS, the Water 5upgly Agreetnent sets forth the tezrr�s by which the SFPUC will <br /> pzoduce, and Che VYhalesale Customers will purchase, water frarn the Hetch Hetchy Regional <br /> Water System for a term of 25-years begiruiing on July 1, 2009; and <br /> VVHEREAS, Heich Hetcb.y Reservoir is the source for 85%o of the water produeed on <br /> average by the Regional Water System and delivered to 2.b �nillian water users in San Francisco, <br /> San Mateo, Santa Clara and Alameda counties; and <br /> WHEREAS, the Water SuppZy Agreement requires that the Regional Wat�r System be <br /> kept in gaod working order and repair consistent with pnadent utility practice and that the <br /> SF�'UC will callaborate with the Wholesale Customers on how best to address possible impacts <br /> to wat�r supply; and <br /> WHEREAS, an November 6, 2012, San Frar�cisco voters considered and rejected an <br /> initiative ordinanc�, Proposition F, that would have required the City to prepare a two-phase plan <br /> evaluating how to drain the Heteb Heichy Reservoir and idenkifying replacement water sou.rces; <br /> and <br /> WHEREAS, the parties have determined that there is uncertainty as to how the parties <br /> would address changes to the Regional Water System in the event of future abandanment or <br /> decomrnissioning of O'Shaughnessy Dam or draining of Hetch Hetchy Reservoir; and <br /> WHEREAS, the parties have negotiated an amendment to the Water Supply Agreernent <br /> ta assur� existing condition of Hetch FIetchy Reservoir is maintained unIess the parties agree ta a <br /> fi�rther amendmeut to the Water Supply Agreement that �eets certai�n conditions; now, therefore, <br /> be it <br /> RESOLVED, the amendment to the Water Supply Agreement serves a substantial public <br /> interest and it is i.n the interest of the SFPUC to amend the Water Supply Agreement with the <br /> Wholesa�e Customers; and, be it f�uther <br /> RFSOLVED, the Cnmmission h�reby authorizes the General Manager to negotiate and <br /> execute an Amendment to the Water 5uppiy Agreem�nt on behalf af the SFPUC in substantially <br /> the form set farth i� this Resolution, gro�ided that the amendment is approved by the Who�esale <br /> Customers pus�suant ta Water Supply Agreement Section 2.03; and be it further <br /> RESOLVED, the Comrnissian directs staff to take a�l steps necessary to SECLIFe the <br /> approvai of the Amendment to the Agreement by the Wholesale Customers; and recommends <br /> that the Wt;oIesaIe Custom�rs approve the amendment to the Agreement. <br /> I hereby certify tha[ the foregoing resalution was adopted 6y rhe Pu61ic Utilrries <br /> Cammission at rts meeting of]anuary 22, ZOi3. <br /> �Z-�- <br /> � Secretary, Public UtlUrles Cammission <br />
