6.3.E. - Page 13 Section 3.1.$ Water Sup�lV A�reement Amendment ReQUired San Francisco may r�ot change the �xisting condition of the Hetch Hetchy Reservoir by: (1} abandoning or decommissioning O'Shaughnessy Dam; or (2) dra�ning Hetch Hetchy Reservair, except for pu�poses of(i) repair, rehabilitation, maintenance, improvem�nt, or reconstruction af O'Shaughnessy Dam or appurtenances, (ii) supplying water to the Bay Area during drought, or (iii} meeting water release requirements under the Raker Act, or f�deral or state law, unless the parties enter inta an amencfinent to t��e Water Supply Agreement, in full force and ef�ect, adopted in accordance with Section 2.03. The amendment shall state, or restake, as the case may be: A. Ttae level of service goals for seismic reliability and delivery reliability adopted by the Commission in conjunction with such propased changes to the Regional Wat�r System, provided such goals are at least as protective af the Whol�sal� Customers as the le�el of service goals adopted by the Co�runission on October 30, 20a8 in conjunctian with th� WSIP; B. The level of water quality to be delivered, which is cuzrently provided for in Section 3.08, and C. The specific cost aliocation procedures, written as an amendment to Article 5, which apply to {1} th� abandonment or decoz�nnnissioning af O'Shaughnessy Dam, or {2) the draining of Hetch Hetchy Reservoir, and (3} the developrnent, operation and maintenance of New Regional Assets that may be required to replace water supplied by HeEch Hetchy Reservoir and delivered to the Bay Area. In the event that the parties are not able to agree upon and apprave an am�ndment to the Water 5upply Agreement as set forth above, San Francisco may not abandon or decommission O'Shaughnessy Dam or drain Hetch.
