SECOND AMENDMENT TO <br />THE FUNDING AGREEMENT <br />BETWEEN THE SAN MATEO COUNTY TRANSPORTATION AUTHORITY AND <br />THE CITY OF REDWOOD CITY <br />FOR THE <br />HUDSON STREET BICYCLE AND PEDESTRIAN IMPROVEMENTS PROJECT <br />THIS SECOND AMENDMENT to FUNDING AGREEMENT for SAN MATEO <br />COUNTY NEW MEASURE A PEDESTRIAN AND BICYCLE PROGRAM FUNDS for the <br />CITY OF REDWOOD CITY HUDSON STREET BICYCLE AlPED <br />IMPROVEMENTS PROJECT ("Funding Agreement") is made as of the ay of <br />2018 (Effective Date), by and between the San Mateo County Transportation Authority A") <br />and the City of Redwood City ("Sponsor"), referred to herein individually as "Party" and jointly <br />as "Parties." <br />WHEREAS, on July 7, 2011, through Resolution 2011-11, the TA Board of Directors <br />programmed and allocated up to $532,640 in Measure A Pedestrian and Bicycle Program funds <br />for the preliminary engineering, final design and construction ("Scope of Work"), for the Hudson <br />Street Bicycle and Pedestrian Improvements Project ("Project"); and <br />WHEREAS, the Parties entered into a Funding Agreement for the Project on April 1, <br />2013; and <br />WHEREAS, the Parties entered into a first amendment to the Funding Agreement on <br />July 20, 2016 ("First Amendment") to extend the time for the Sponsor to complete the Scope of <br />Work; and <br />WHEREAS, delays in receiving the traffic signal equipment, unmarked utility conflicts <br />and damaged Caltrans infrastructure on Woodside Road all contributed to further delay the <br />Sponsor's completion of the Scope of Work and so the Sponsor submitted a request on April 26, <br />2018 requesting to allow for a fifteen -month extension from July 7, 2017 to October 7, 2018 to <br />complete the Scope of Work, including concluding the construction phase and obtaining Caltrans <br />approvals; and <br />WHEREAS, the Parties desire to enter into a second amendment to the Funding <br />Agreement to allow the Sponsor one additional year to complete the Scope of Work, and the <br />Sponsor will continue to contribute, or otherwise provide for the contribution of, any amount in <br />excess of $532,640 of Measure A Pedestrian and Bicycle Program funds needed to implement <br />the Project. <br />IT IS HEREBY AGREED by the Parties that the Funding Agreement is revised and <br />amended as follows: <br />San Mateo County Transportation Authority/ City of Redwood City <br />Second Amendment to the Hudson Street Bicycle and Pedestrian Improvements Project <br />1 14382337.1 <br />/ablU�r�rlend No. 2 /San Mateo County Transportation Authority <br />
