SECOND AMENDMENT TO THE FUNDING AGREEMENT BETWEEN THE SAN MATEO COUNTY TRANSPORTATION AUTHORITY AND THE CITY OF REDWOOD CITY FOR THE HUDSON STREET BICYCLE AND PEDESTRIAN IMPROVEMENTS PROJECT THIS SECOND AMENDMENT to FUNDING AGREEMENT for SAN MATEO COUNTY NEW MEASURE A PEDESTRIAN AND BICYCLE PROGRAM FUNDS for the CITY OF REDWOOD CITY HUDSON STREET BICYCLE AlPED IMPROVEMENTS PROJECT ("Funding Agreement") is made as of the ay of 2018 (Effective Date), by and between the San Mateo County Transportation Authority A") and the City of Redwood City ("Sponsor"), referred to herein individually as "Party" and jointly as "Parties." WHEREAS, on July 7, 2011, through Resolution 2011-11, the TA Board of Directors programmed and allocated up to $532,640 in Measure A Pedestrian and Bicycle Program funds for the preliminary engineering, final design and construction ("Scope of Work"), for the Hudson Street Bicycle and Pedestrian Improvements Project ("Project"); and WHEREAS, the Parties entered into a Funding Agreement for the Project on April 1, 2013; and WHEREAS, the Parties entered into a first amendment to the Funding Agreement on July 20, 2016 ("First Amendment") to extend the time for the Sponsor to complete the Scope of Work; and WHEREAS, delays in receiving the traffic signal equipment, unmarked utility conflicts and damaged Caltrans infrastructure on Woodside Road all contributed to further delay the Sponsor's completion of the Scope of Work and so the Sponsor submitted a request on April 26, 2018 requesting to allow for a fifteen -month extension from July 7, 2017 to October 7, 2018 to complete the Scope of Work, including concluding the construction phase and obtaining Caltrans approvals; and WHEREAS, the Parties desire to enter into a second amendment to the Funding Agreement to allow the Sponsor one additional year to complete the Scope of Work, and the Sponsor will continue to contribute, or otherwise provide for the contribution of, any amount in excess of $532,640 of Measure A Pedestrian and Bicycle Program funds needed to implement the Project.
