Part 2�ells the story of the boaters still there, <br /> who have special circumstances, as well as what has been gaing on `an the ground'. <br /> Part 1 <br /> Only the `49ers Own the Bay <br /> Well rriaybe the Giants, Warriors and 5harks too. But that's the point, only our sports teams own the <br /> Bay. I saw a Redwood City `9ers fan wearing his "Own the Bay" shirt, and it hit home and summed up <br /> perfectly what the fight o�er the outer harbor at Pete's Harbor in Redwood City has been about. it's <br /> about who owns the Bay and what should be done with it. This has been an emotional, dramatic, knotk <br /> dawn and drag out fight over simply nat pri�atEZing the 8ay for awners of Iuxury condas along the <br /> shoreiine. It could anc! should ha�e been different. <br /> Public trust uses include commerce, na�igation,fishing and recreation, and a public and cammercial <br /> harbor and marina with liveaboards ad�ances all these public trust uses. During the public hearings in <br /> Redwoad City, dozens of supporters af the landowner repeated the mantra that boaters had 10 years to <br /> prepare for moving. But it is now clear the City, fancEowner, out-of-state developer and their friends and <br /> supporters ha�e had 10 years to in�estigate whether it is right, praper and e�en lawful ta perrr�it pri�ate <br /> and exclusive boat slips in ti�e Bay. I#does nat appear t�at e�en one City official addressed the State <br /> Lands Commission in the 10 year period from the 20D3 proposecE Marina Shores Planned Community to <br /> the present.The de�eloper and landowner met with the State Lands Commission only on September 18, <br /> 2012, two days before telling tenants of an impending single hearing to appro�e the deal. In addition, <br /> Redwood City's 2010 Ceneral Plan expressly states it will keep liveaboards with the 411 unit conda <br /> development, and boaters relied on that during this time period. <br /> To be sure,there are pri�ate commercial operations alang the Bay now, but those are open to the <br /> pub[ic. All the marinas Baywide lease to the boating public of recreational and commercial boaters. Not <br /> all marinas have liveaboards (the Bay Conservation and De�elopment Commission allows 1Q%of <br /> permitted slips as livea�oardsj, but many da. To have allawed privatization at Pete's would ha�e set a <br /> terrible precedent, not only far Redwood City waters but far the whole Bayshore.That crisis has been <br /> a�erted by public advocacy and the developer changing its design to include a commercial harbor and <br /> marina at Pete's. However,the lease application to the State states the intent to rip out most of the <br /> smaller area "consent" lease nearthe old Harbor House restaurant. Potentially most of the slips along <br /> the water in the "transfer" lease (not needing consent) wauld also be rerr�oved. This would lea�e only <br /> the farthest slips abutting Redwood Creek (the on4y ones with fire hoses on them, apparently this plan <br /> was known to the harbor for years, re5ulting in neglect af most outer harbo r slips and pratecting onfy <br /> the ones intended to remainJ. In addition, there is no parking currently slated forthis public and <br />
