If the semi-subterranean garage wilf necessitate groundwater <br /> pumping into the sewer system, a Discharge fee will apply ar�d a Discharge <br /> Permit will be required by South Baysid� System Authority {SBSA) and the City <br /> of Redwood City. <br /> 46. Parking garage ramps shall be designed in confarrriance with <br /> Volume I[I af the Engineering Stancfards, ancf shal! consider safety and visibility <br /> of pedestrians to the satisfaction of the City Engineer. <br /> 47. Prior to removing any �ublic parking spaces from public use during <br /> construction, fihe applicant shall apply for Parking Meter Construction Zone <br /> Hoods per Municipal Code SECtf01�5 20.'!75 through 20.183. Parking meter <br /> construction zone hoods shall be issued upon payment of a deposit of ten dollars <br /> ($10.04) per hood issued, refundabie upan return afi the hoods, and a <br /> nonrefundable fee of three dollars ($3.00) per day per hood issued. <br /> 48. Prior to Parcel Map approvaf, the applicant sha[l pravide a shared <br /> parking covenant (in a form acceptable ta the Community Development Director <br /> and the City Attorney) providir�g the City wi#h assurance that the shared parking <br /> obligations under the Downtown Precise Plan with respect to the project will be <br /> met and to assure that public parking supparking the downtawn businesses will <br /> be provicfed for the commercial component of the project, af a minimum Monday <br /> through Friday, S:flO a.m. #a 5:00 p.m. The shared parking covenant shall be <br /> recorded against the proper�y alang with the Final Map. <br /> 49. Pursuant to Section 66474.9(b) of the California Governrrj�nt Code <br /> andlor Redwood City Municipal Code Section 1.54, Applicant shall defend, <br /> indemnify, and hold harmless the City, its agents, afficers, and employees from <br /> any claim, action, or praceeding against the City or its agents, officers or <br /> employees, to attack, set aside, void, or annui an approval of the City, including <br /> but not limited to the City, and the City's ager�ts, afficers or employees, <br /> concerning the tentati�e parcel map andlar de�elopment permit. The City shall <br /> promptly notify Applicant of any such claim, action or proceeding and shall <br /> cooperate fuily in the defense. <br /> 50. No building or zoning permit shalf be issued, ar�d no use shall be <br /> established except in accordance with and subject to the terms a�d canditions <br /> outlined abave, and in no case shall such permit be issued ar use estabiished <br /> priar to the finaf actian on any appeals that may be �led within the appeal period. <br /> Any appeal made ir� accordance with the provisions of Section 2A.3 of the DTPP <br /> is to the Planning Cammission and must be recei�ed �y the City Clerk no lat�r <br /> than fifteen calendar days after the date of the notice of afficial action. As such, <br /> this appraval shall become effective on the sixteenth (16fh} day fol{owing the <br /> date of the notice of a�proval by the Zoning Administrator unfess an appea{ ta <br /> said decision has be�n fifed in accorcEance with the provisions stated above. <br /> Section 4.
