She <br /> believes the developers should resubmit their application. <br /> James Lee stated that he would like the Council to show the same respect that they <br /> requested from members of Occupy Redwood City. He also opined that invocations <br /> were becoming like prayers and he does not stand during the pledge of allegiance <br /> either. Mr. Lee said that most, if not all, Council Members should recuse themselves. <br /> He pointed out that on March 22nd work was conducted at the Harbor, which was <br /> against the State Lands Commission orders. He opined the Environmental Impact <br /> Report (EIR) is 10 years old and new impacts have come to the area. He opined that <br /> affordable housing is needed. <br /> Jerry Carlson, Vice Mayor of Atherton, asked Council to consider and support SB 557, <br /> High Speed Rail Funding. It guarantees that electrification will be funded and not go to <br /> other funds. Nine members of the State committee are needed to approve this bill. <br /> Also, Vice Mayor Carlson supported the Kainos funding on the agenda. <br /> Andy Frish, on behalf of Kainos, thanked the City, staff, and community for their <br /> support, specifically approving housing for older adults with developmental disabilities. <br /> He also stated that he is a member of Redwood City Together and they want to have <br /> further development and an inclusive community. He also acknowledged many Kainos <br /> Board members in attendance. <br /> Rick Drain, representing Save Pete's Harbor Inc., wants Redwood City to have a <br /> commercially viable public access marina. He is supportive of a public marina, but <br /> when the Planning Commission and Council approved it, if anything changes, he opined <br /> that Council should drop it. He suggested that instead of going through an appeal, let's <br /> start over and instead come up with a good plan for a good marina. <br /> Ben Paul stated that he had met many City staff and attended many Council meetings <br /> throughout the Peninsula. He opined that (Redwood) City staff and City Council have <br /> an excellent reputation for doing an excellent job in listening to the public. Thus, they <br /> have earned and deserve their reputation. <br /> Trista Bernstein, Executive Director of Broadway by the Bay, said that they started their <br /> 2013 season last Saturday of Cats at the Fox Theatre. She invited all to attend. <br /> Pamela Thompson, City Attorney, clarified some statements that were made under <br /> Public Comment. She said that campaign contributions, up to a certain amount, do not <br /> disqualify Council Members from participating in projects. Another point she made <br /> concerning the 10-year old EIR (Environmental Impact Report) concerning Pete's <br /> Harbor, is that EIRs do not have a shelf life. The City evaluates the validity of the EIR. <br /> There was also an addendum of environmental work pertaining to this project. <br /> Furthermore, with regards to the status of Pete's Harbor, the Planning Commission <br /> approved the project; and the appeal is still pending before the City Council. The <br /> appeal cannot be dropped, because both parties have a right to be heard on this issue. <br /> Lastly, another statement that the City Attorney wanted to clarify is that prayer at public <br /> meetings is not disallowed, if it does not promote a particular religion. <br /> CTY COUNCIL April 8, 2013 <br /> MEETING MINUTES PAGE 3 <br />
