6.1.C. - Page 3 <br /> RAILROAD CONSTRUCTION AND MAINTENANCE AGREEMENT <br /> CALTRAIN SAFETY IMPROVEMENTS PROJECT <br /> This Railroad Construction and Maintenance Agreement (the "Agreement") is entered <br /> into this day of , 2013, by and between the Peninsula Corridor Joint <br /> Powers Board, a public agency ("JPB" or "Railroad"), and the City of Redwood City, a charter <br /> city and municipal corporation ("City"). <br /> RECITALS <br /> A. Redwood City is a charter city and duly established municipal corporation <br /> organized and existing under the laws of the State of California. JPB is a public agency <br /> organized and existing under the laws of the State of California. <br /> B. JPB is the co-owner of the railroad right-of-way, and specifically that certain real <br /> property, fixtures and facilities located in the City of Redwood City between Railroad Mile Posts <br /> 24.5 and 26.5 (the "Right-of-Way"). City owns and maintains certain streets and related <br /> improvements in the vicinity of the Right-of-Way. <br /> C. City wishes to cooperate with Railroad in the design, construction and <br /> maintenance of advance signal preemption improvements to existing grade crossing in the City <br /> of Redwood City located at Brewster Avenue (CPUC No. 105E-252; U.S. DOT No.754936G), <br /> (the "Crossing"). These safety improvements are specified in JPB Construction Contract 12- <br /> PCJPB-C-036 Caltrain Signal Premption Improvements — JPB Crossings and all attachments, <br /> exhibits and addenda thereto ("Construction Contract"), and plans submitted to and approved by <br /> the California Public Utilities Commission under its General Order 88-B (the "Project"). The <br /> safety improvements include: <br /> Installing one CA MUTCD standard W16-1 "Share the Road" sign to <br /> enhance bicycle safety; <br /> Installing 2 additional traffic phases at the Brewster/Arguello intersection <br /> as shown in the proj ect documents; <br /> Installing new traffic signal control cabinet; <br /> Installing new underground PVC conduit for signal lines; <br /> Installing new signal controller, battery back up in Traffic control cabinet; <br /> Installing new Traffic Signal Heads and pedestrian "countdown" type <br /> signal heads; and <br /> Installing Advance preemption and signal timing. <br /> ATTY/AGR/2013.021/JPB RAILROAD CONSTRUCTION&MAINTENANCE AGREEMENT <br /> REV:OS-29-13 VR <br /> Page 1 of 8 <br /> 4799109.2 <br />
