Each of the Agencies has accepted the recom- <br /> mendations of the Project Report to proceed with the construction <br /> of Stage 1 of the Project. The Authority shall construct all <br /> elements of Stage 1 of the Project, including those elements <br /> that will be used by less than all of the Agencies. Each <br /> Agency agrees to take the necessary steps to obtain funds to <br /> bear its share of the capital costs and costs of special ser- <br /> vices of Stage 1 of the Project, all determined as provided <br /> in Section 5.9. Upon receiving written approval from each <br /> of the Agencies the Authority may proceed to cause the prepa- <br /> ration of plans and specifications for Stage I of the Project <br /> and to call for construction bids. Upon certification from <br /> each of the Agencies to the Authority of the availability of <br /> its share of the capital costs and costs of special services <br /> of Stage 1 of the Project, the Authority shall proceed with <br /> the construction of Stage 1 of the Project. Except to the <br /> extent that funds required for payment ,of the capital costs <br /> and costs of special services of Stage 1 of the Project are <br /> provided from the proceeds of sale of revenue bonds issued <br /> by the Authority under the Bond Law or the Act, such funds <br /> shall be provided by the Agencies. All such funds required <br /> by the Authority from each Agency shall be payable on demand <br /> by such Agency and shall be paid by such Agency within thirty <br /> days of billing therefor by the Authority. Funds advanced <br /> by the Agencies and grant funds received from the State and <br /> from the United States of America shall be deposited in the <br /> Construction Fund of the Authority (which is hereby created) <br /> and applied by it to payment of the capital costs and costs <br /> of special services of Stage 1 of the Project. Funds remaining <br /> after completion of construction of Stage 1 of the Project <br /> shall be returned to the Agencies in proportion to their res- <br /> pective contributions. <br /> 21 <br /> 1005044 <br />
