The ina.tial pot�ntial treatment capacity rights of the <br /> respective Agencies to the capacity proposec� to be constructed and <br /> established for each Substage of Stage 2 of the Project shall be <br /> allocated in proportionate shares equivalent to the proportionate <br /> ownersYtip of each such Agency to the capaci�y rights for Stage 1 <br /> af the Project. Said capacity righ�.s shall be expre�sed in <br /> gallons per day volume of Average Daily Dry Wea�her Flow, for each <br /> of which there shall be cerresponding cancentrations of <br /> Biachemical Oxyger_ Demand and Suspended Solids of 325 milligrams <br /> pe� liter (Mg/L) day, each. <br /> "G?ith the prior written approval af the Commission, <br /> any Agency may relinquish to any other Agency any portzon of <br /> � its i.nitial potential capacity rights as agreed upon by <br /> � said two Agenci�s prior to cammencement of construction of any <br /> such Subs�age. Thereupon the Agency so abtaining such <br /> relinquished riqhts shall be entitled t� obtain maximum capacity <br /> rights equal to the sum of its initial rights plus its acquired <br /> rights. <br /> "With respect to Substage 1, the respective'capacity <br /> rights of the Agencies shall accrue upan canstructi.on thereaf; <br /> provided, however, that each Agency shall reimburse the Authority <br /> according to its respeative allocated share of the costs of <br /> construction thereof based upon its respective proportionate <br /> ownership of capacity rights pursuant to Subdivision ib) of <br /> Section 5.6 prior to acquir,ing any further capacity rights.
