��S:djg-c 2/21/84 <br /> - � �'�:djg-c 3/45/84R <br /> D�;S:djg-c 3/12I84R <br /> �� notify any Agency in writing at uzzy time that such Agerccy's use of <br /> the Joint Faciliti�s has exceeded its maximum capacity rights, <br /> such Agency shall immediately tak� steps to r@C1L10E its use of the <br /> Joint Facilities so as to be within its maximum capacity rights. <br /> If any Agency is unabZe to do so, it may, with written approval of <br /> the Autharity: <br /> (i) Purchase or lease capacity from any other <br /> Agency which has surplus or unused capacity <br /> rights, or <br /> (ii) At its own expense, provide for modifications <br /> to pumping, conveyance ox treatment facilities <br /> so as to accan�modate its excess use of the <br /> � Joint Facilities. <br /> Should any Agency fail to cornply with the provisions of this <br /> Subdivisian, the Authority may take ar.y necessary action under <br /> Sec�ion 7. � or Section 7. 6 . " <br /> 15. Section 7.3 of the Agreement is hereby amended to read <br /> as follows: <br /> "Section 7.3. Transfers. With the prior written ' <br /> approval of the Commission any Agency may sell, ].ease ar assign ta <br /> any other Agency any portion of its maximum capacity rights as <br /> agreed upan by said two Agencies. Upon any such sale, Iease or <br /> ass�gnment, the Commission shall adjust the maximum capacity <br /> riqhts of sai.d two Agencies to reflect such saZe, lease or <br /> assignment. Such adjustment shall be effective on July lst of the <br /> fiscal year follawing such sale, lease or assignment. <br /> � <br /> 17 <br />
