<br /> D~,S: djg-c 2/21/84 <br />. ,;-3: djg-c 3/05/84R <br /> D£S:djg-c 3/12/84R <br />0"',.. <br />. notify any Agency in writing at any time that such Agency's use of <br /> the Joint Facilities has exceeded its maximum capacity rights, <br /> such Agency shall immediately take steps to reduce its use of the <br /> Joint Facilities so as to be within its maximum capacity rights. <br /> If any Agency is unable to do so, it may, with written approval of <br /> the Authority: <br /> (i) Purchase or lease capacity from any other <br /> Agency which has surplus or unused capacity <br /> rights, or <br /> (ii) At its own expense, provide for modifications <br /> to pumping, conveyance or treatment facilities <br /> so as to accon@odate its excess use of the <br />. Joint Facilities. <br /> Should any Agency fail to comply with the provisions of this <br /> Subdivision, the Authority may take any necessary action under <br /> Section 7.4 or Section 7.6. II <br /> 15. Section 7.3 of the Agreement is hereby amended to read <br /> as follows: <br /> IISection 7.3. Transfers. With the prior written <br /> approval of the Commission any Agency may sell, lease or assign to <br /> any other Agency any portion of its maximum capacity rights as <br /> agreed upon by said two Agencies. Upon any such sale, lease or <br /> assignment, the Commission shall adjust the maximum capacity <br /> rights of said two Agencies to reflect such sale, lease or <br /> assignment. Such adjustment shall be effective on July 1st of the <br />.' fiscal year following such sale, lease or assignment. <br /> 17 <br />
