Terrence D. Meagher, 237 Oakview Dr., San Carlos urging support of the report as written. Ralph A. Nobles, 3720 Country Club Drive, Redwood City, recommending acceptance of report. Council for Governmental Responsibility, 2995 Summit Dr., Hillsborough, urging approval of report. Marian Lockwood, 1043 Sonoma Ave., ?Menlo Park, urging acceptance of report. Redwood Cit- Civic Association urging approval of report. City Attorney felt it should be noted that Redwood City was the original City to protest on bay -fill and take action. Councilman Royer recommended report be accepted by Council with one amendment he had noted. Councilman Granger moved to accept recommendation as presented by Bay -Front Committee, with exception and amendment as noted for submission to County Regional. Planning Commission, seconded by Councilman Petersen and carried. ( MINUTE ORDER #66-4-() Councilman Bury moved to adopt RESOLUTION NO. 4928 :UTHORTZING AND DIRECTING ISSUANCE OF REPLACEMENT BONDS BY THE REDWOOD CITY TREASURER. Councilman Granger asi�,ed if this was approved by the City Attorney and requestion such statement be placed in the Resolution if it was not contained. City Attorney stated it was approved by him and would be stated in the resolution. Motion seconded by Councilman Granger and carried on roll call vote, Councilman Herkner being noted absent. Acceptance of Shepard May Improvements. City Attorney stated he had advised con- tinuance of this matter until he could check legal suit which had been filed, involving construction of improvements and if improvements now accepted by Coun- cil he would recommend following be added to the usual conditions of acceptance: "This acceptance shall. not operate to release the contractor or his surety from his obligations to protect, defend and hold the City harmless from any loss arising out of the lawsuit filed by Robert w. and Selma Brooks and this acceptance shall not be effective except on receipt of written confirmation of this obligation from the contractor and his attorney." Councilman Royer moved to accept Shepard Way and Vicinity Improvements subject to usual guarantees and added condition as submitted by City Attorney, seconded by Councilman Weymouth and carried. (MINUTE ORDER ;t66-48) Councilman Royer stated he would abstain from action on the following item because of business interests. Councilman Granger moved to adopt RESOLUTION NO. 4929 ACKNOT,'LEDGING THE RECEIPT OF NOTICE OF INTENTION TO CIRCULATE A PETITION FOR THE ANNEXATION OF TERRITORY DESIGNATED "VISTA DRIVE ANNEXATION" AND AN AFFIDAVIT OF PUBLICATION THEREOF; AND, APPROVING THE CIRCULATION OF THE PETITION.
