Livermore <br /> Judge of the Superior Court <br /> c/o Charlene Kresevich <br /> Hall of Justice <br /> 400 County Center, 2� Floor <br /> Redwood City, CA 94063-1655 <br /> Re: Grand Jury Report: South Bayside Waste Management Authority (SBWMA) Board-Elected Officials or <br /> Senior Management Staff <br /> Dear Judge Livermore: <br /> On behalf of the City Council of Redwood City, I am responding to the above referenced report. <br /> At its meeting of July 22, 2013, the City Council approved this response. <br /> Before directly responding to the Grand Jury's findings and recommendations, the Council <br /> would like to provide the appropriate context for the discussion of SBWMA governance. This <br /> context is framed by three threshold questions which, together, support having elected officials <br /> serve on the SBWMA board: <br /> 1) Is the public trust served by having elected officials overseeing a public agency with <br /> revenues of over $40 million and operating expenses of $36.5 million annually? <br /> The City Council feels that the public trust is best served by having elected officials, <br /> accountable to their respective citizenry, overseeing this public entity, especially one whose <br /> actions continue to be a target of close scrutiny by the public and media. SBMWA's budget <br /> alone is larger than some cities' general fund budgets, which are of course overseen by <br /> elected officials. <br /> 2) Who is ultimately accountable to the public? <br /> In 2009, the San Mateo County Civil Grand Jury issued a report entitled "Trash Talk: <br /> Rethinking the Waste Management RFP Process by the SBWMA"� In it, the Grand Jury <br /> recommended that elected officials serve on the board. The Grand Jury recommended this <br /> based on Finding #2 in its report which stated, "Whether or not elected officials from the <br /> member agencies are on the SBWMA Board of Directors, these elected officials are <br /> ultimately responsible for all actions taken by the SBWMA."
