E. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> July 22, 2013 <br /> SUBJECT <br /> Middlefield Road Underground Utility District Boundary Map and Legal Description <br /> Revision— Resolution of Intent <br /> RECOMMENDATION <br /> Adopt a Resolution of Intent to set a Public Hearing on August 26, 2013 concerning <br /> exclusion and addition of territory by modifying the boundaries of the Middlefield Road <br /> Underground Utility District 2011-1 <br /> BACKGROUND <br /> On February 6, 2012, Council adopted the Middlefield Road Underground Utility District <br /> 2011-1 (MUUD). Pursuant to Municipal Code Chapter 11, Article 2, Sec. 11.44., any <br /> revision to the boundary of the district requires a public hearing and an amendment to <br /> the ordinance. <br /> The purpose of the public hearing is to inform the property owners within the district of <br /> the changes to the boundary. Upon City Council's confirmation the proposed public <br /> hearing would be set for August 26, 2013. As such, the affected property owners will be <br /> given notice of the public hearing through a direct mailing and notice in the newspaper <br /> at least ten days before the scheduled hearing. <br /> Additional adjustments to the boundary may be required if a utility company requests <br /> modifications and they result in exclusion or addition to the underground district territory. <br /> ANALYSIS <br /> The underground district encompasses Middlefield Road from Main Street to MacArthur <br /> Avenue and along certain side streets as shown in the attached boundary map and <br /> described in the legal description. Since the adoption of the district, minor changes to <br /> the boundaries of the underground district have been identified as necessary for varying <br /> reasons: <br /> 1) PG&E requested matching the City and County underground district lines which <br /> fall on the street centerline on Douglas Ave. This is due to the CA Public Utilities <br /> Commission requirement that Rule 20A projects include both sides of the street. <br /> 2) The property at 425 Douglas Ave. is currently located within the district, but is <br /> served from a pole outside the district; therefore, there is no need for this <br /> property to be included in the district. <br />
