possibly add their own road at their own cost to get people in, and mentioned that
children at (nearby) Hoover School need to be protected.
David Franklin, partner with the law firm of McKenna Long & Aldridge representing
Costco, stated that the question/issue is whether or not 20 pumps will have a better or
worse impact. He opined that the 20 pumps will make things better.
Andy Chow, a resident for over 20 years, says he owns a one person transportation
business and he spoke in favor of competition's impact on prices and the role Costco
plays in keeping the prices lower. He opined that traffic is the more legitimate issue as
opposed to competition, and he expressed confidence in Council's decision.
M/S Seybert/Ira to close the public hearing. Motion carried unanimously by voice
vote.
Recommendation:
1. Hold a Public Hearing on the Appeals of the October 16, 2012 Planning Commission
Actions.
2. Adopt a Resolution, (1) denying the appeal of Andy Saberi, Andy's BP, Inc. and Fifth
Avenue Enterprises, Inc. and (2) granting the appeal of Costco Wholesale Corporation,
thereby modifying the Planning Commission's Approval of the Costco Gasoline Station
Expansion Project to allow for a 20 fueling position gas station after considering
Addendum No. 2 and the 2007 EIR.
RESOLUTION 15249 OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DENYING
THE APPEAL FILED BY ANDY SABERI, ANDY'S BP, INC. AND FIFTH AVENUE
ENTERPRISES, INC., GRANTING THE APPEAL OF COSTCO WHOLESALE
CORPORATION, AND MODIFYING THE PLANNING COMMISSION'S APPROVALS OF A
USE PERMIT MODIFICATION AND A NEW ARCHITECTURAL PERMIT FOR THE COSTCO
GASOLINE STATION EXPANSION PROJECT AT 2300 MIDDLEFIELD ROAD
M/S Seybert/Ira to adopt the revised resolution as submitted.
One Council Member commented that he will vote against it because he supports 16
pumps as recommended by the Planning Commission. Another Council Member said
she will take that same position because she believes it is a better approach to go for 16
versus 20 pumps. Yet anotherCouncil Member shared that she too will vote against it
because of the nuanced layers of business needs and residents' needs. She believes
that the 16 pumps would have worked out and she expressed her sentiments in regards
to being a good corporate citizen and how being part of the community you serve is also
something that should be considered. This Council Member believes in compromise,
and she believes that 16 pumps would be a good compromise.
Mayor Aguirre said that she will support the motion, because she has done the math
and more pumps will offer more choices and make the flow smoother.
CITY COUNCIL March 11, 2013
MEETING MINUTES PAGE 8
MINUTE BOOK NO. 64
Page No. 299
