except Lot A, to have less than} -50 feet of street frontage, to <br /> have less than 90 feet of lot depth, and to have less than 6,000 <br /> square feet of lot area. <br /> 2 . The exceptions set forth in paragraph 1 hereof are granted <br /> subject to the following conditions relating to Petitioner' s request <br /> for a subdivision of the above described real property heretofore <br /> conditionally approved by the Planning Commission: <br /> a. That a Homeowners ' Association be organized for <br /> maintenance and operation of the common areas, <br /> structures, and facilities, including the exterior <br /> portions of the existing structure. As a condition <br /> of purchase of each unit of the condominium develop- <br /> ment, each owner shall be required to be a member <br /> of the Homeowners ' Association, shall be assessed a <br /> sufficient sum to adequately provide for the <br /> maintenance and operation of the aforementioned <br /> common areas, structures and facilities, and shall <br /> have any assessment of the Association placed as <br /> a lien against his property if not paid. <br /> b. That all sanitary and storm drain facilities located <br /> on the site be under private ownership. <br /> c. That the water system improvements required by the <br /> Public Works Department be installed to City standards. <br /> d. That the design of all sanitary, storm drain, and <br /> water facilities, including easements, be approved <br /> by the Public Works Department. <br /> e. That the existing concrete sidewalk and curb <br /> along Gordon Street, which has been damaged prior <br /> to the commencement of this condominium project <br /> or which may be damaged during, or as a result <br /> of this condominium project, be replaced or <br /> repaired at the expense of the developer. <br /> f. That provisions for fire safety and all fire <br /> safety improvements to provide for such fire <br /> safety be made as required by the Fire Chief. <br /> * * * <br /> -2- <br />
