<br /> -- - _n -- ------~ -_.~_.- ---- --- - -- --- <br /> Mr. Davies said he has a good firm of attorneys, and is asking the <br /> Agency to put this matter on ice to allow him time to work out <br /> something with Safeway. <br /> Carol Mittlesteadt, Redwood City Attorney representing Rosalie Davies, <br /> advised the Directors of the Agency her client had not made a decision <br /> and preferred to wait to hear what Mr. Davies was to say tonight. <br /> Ms. Mittlesteadt advised that Mrs. Davies had met with Mr. Michaels <br /> and asked for clarification on two matters: It was her understanding <br /> that the corner parcel upon which Park Chevrolet is doing business was <br /> not included in the Sequoia Station Project, and in order for it to be <br /> included the Plan would have to be amended. <br /> Mr. Church advised the dealership parcel is not currently in the site <br /> plan and was only included in the Redevelopment Area in December 1989. <br /> As of tonight no decision had been made to incorporate that parcel <br /> into the Project. <br /> Ms. Mittlesteadt asked for clarification on a second matter: The 200 <br /> feet by 30 feet parcel at the top of the curve of what she called <br /> Franklin Street property had not been included in the offer that had <br /> been made to the Davies. <br /> Mr. Hildebrand stated that was not correct. That parcel is included in <br /> the parcel that the Agency is considering taking this evening. <br /> Ms. Mittlesteadt stated she realized it was included in the legal <br /> description, but asked if it had been included in the square footage <br /> against which the $24 per square foot was calculated. <br /> Mr. Hildebrand advised that that question had been answered by the <br /> appraiser who had looked at the property and the preliminary title <br /> report for the property and concluded that the power of reversion <br /> rendered the ownership of that parcel so questionable that it had no <br /> value, negligible value, and that issue raised the question between the <br /> former owner Southern Pacific and the Davies ownerships now, and can be <br /> resolved between the parties or in court if the Agency goes into <br /> eminent domain. The property will be acquired, but the question is who <br /> gets the money for it. <br /> Ms. Mittlesteadt advised it was her understanding that the reversionary <br /> right had not come into play, she agreed with Mr. Davies on that, and <br /> thanked the Board. <br /> Mr. Alan Phillips stated he was affected by the proceedings as an owner <br /> and as an attorney for another owner advised that he noticed the Notice <br /> of Hearing for this matter was set for Monday, June 8, 1992, and it was <br /> presently June 9th, and wondered if the Board had the authority to <br /> approve anything at this time. <br /> Redevelopment Agency Minutes <br /> June 8, 1992 <br /> Page 8 <br /> MINUTE BOOK NO.1 <br /> Page No. 68 <br />
