<br /> II II ,. <br /> Mr. Attorney Schricker stated that the Board does have the authority. <br /> Mr. Hildebrand asked if anyone representing the property of Home of <br /> Christ Church would like to speak at this time. <br /> - <br /> No one responded or came forward. <br /> Mr. Hildebrand asked if anyone representing the property of Mr. and <br /> Mrs. Sarikakis would like to speak at this time. <br /> No one responded or came forward. <br /> Chairwoman la Berge asked if anyone representing the property of Mr. <br /> and Mrs. Cook would like to speak at this time. <br /> Alan Phillips, attorney representing the Cooks, stated the Cooks owned <br /> the property at 29 and 31 James Avenue for almost nineteen years, and <br /> the specific points to be addressed tonight included the questionable <br /> power the Board has to do anything tonight given the day and time. <br /> Mr. Schricker asked Mr. Phillips if he was requesting a continuance of <br /> this matter. <br /> Mr. Phillips responded he would not waive any rights he had, but asked <br /> the Board to continue this matter due to the late hour. <br /> Special Counsel Adams advised that if the Board voted for the need and <br /> necessity for condemnation tonight, he was prepared to deposit a check <br /> for $1,700,000 for the Cook properties dated tomorrow, and the papers <br /> - are prepared for tomorrow to be filed in court asking for immediate <br /> possession of the property, which takes a minimum of ninety (90) days. <br /> The longer it is postponed the longer it takes to take possession of <br /> the property. Mr. Adams' understanding is that the Project <br /> construction is imminent, and putting it off will be detrimental to the <br /> Project as a whole. Mr. Adams advised proper notice was given and the <br /> hearings commenced on June 8th and are legal, and it is not in the best <br /> interest of the Agency to continue this matter to a further date. <br /> Director Murray advised the notice stated the time for this hearing was <br /> set for 7:30 p.m. or "as soon thereafter as possible", and that <br /> Chairwoman La Berge as Mayor did attempt to move along the prior <br /> hearing, and this hearing should not be continued. The owners and <br /> their attorneys are here and can speak at this time. <br /> Director Greenalch spoke in favor of continuing the hearing. <br /> In response to questions from the Board, Mr. Phillips advised his <br /> clients wanted a continuance for the previous reasons stated, and they <br /> heard tonight for the first time from Mr. Adams that he intends <br /> to take immediate action tomorrow.
