<br />" " ,. <br /> <br /> <br /> <br /> <br />"Recommendation: <br /> <br />That the Board adopt the Resolution of Necessity on the above property <br />for the reasons described in this report. <br /> <br />Legislation <br /> <br />Section 1245.220 of the Code of Civil Procedure states that a public <br />agency may not commence an eminent domain proceeding until its governing <br />body has adopted a resolution of necessity. This resolution must, among <br />other things contain the following four findings: <br /> <br />1. The public interest and necessity require the proposed project. <br /> <br />2. The proposed project is planned or located in a manner <br />that will be most compatible with the greatest public good and <br />the least private injury. <br /> <br />3. The property described in the resolution is necessary for the <br />proposed project; and <br /> <br />4. That the offer required by Section 7267.2 of the Government Code <br />has been made to the owner. <br /> <br />Each of these findings will be discussed in order. <br /> <br />1. The public interest and necessity require the proposed project. <br /> <br />I <br />I The "project" definition approved by the Board at the March 9, 1992 <br />L-- Board Meeting was as follows: <br /> <br />"The project being evaluated in this Addendum to the EIR is the <br />demolition of the existing buildings and their replacement with <br />between 20-24 units of two-story condominiums that would be for <br />rental rather than sale. The City's Housing Element and the <br />Comprehensive Housing Affordability Strategy both indicate that over <br />90% of the housing need is for rental housing. The specific form of <br />the project will determined by the eventual developer. Staff <br />recommends that an experienced not-for-profit developer be used to <br />build these units." <br /> <br />The public interest and necessity requires this project for the following <br />reasons: <br /> <br />a) This parcel was incorporated into the Redevelopment Area in 1990. <br />The Report to the City Council on this amendment to the Redevelopment <br />Area made a detailed analysis of the blighting influences as defined <br />by the Community Redevelopment Law. The former "Whipple Lodge" was <br />identified as one of the factors contributing to blight.
