�. � <br /> �:r.. „ ,�_ <br /> 10. _CQNDITION OF PREMISES. Permittee shall, at its own cost and <br /> expense, keep and maintain the Subject Premises, including any equipment <br /> placed or stored thereon, in reasonable order and repair, and shall keep all <br /> portions of the Subject Premises clean, neat, orderly and free of papers, debris, <br /> wastes, or other articles or things which increase the danger of fire or detract <br /> from the aesthetic appearance of the Subject Premises. Permittee shall, at its <br /> own cost and expense, conduct all operations on, and use of, the Subject <br /> Premises in such manner as to avoid discharging dust, solids, fumes, odors, <br /> gases, or liquids into or on the Subject Premises, or otherwise into the <br /> environment so as to pollute the same. Permittee shall not bring, place, or store <br /> upon the Subject Premises any hazardous wastes or material or other such thing <br /> or substance, except such fuel, oil, or other petroleum products necessarily <br /> required for the operation and maintenance of the equipment to be stored on the <br /> Subject Premises pursuant hereto and safety contained within said equipment. <br /> Permittee further agrees to enclose the Subject Property with a cyclone <br /> fence or other type of fence approved in advanced by City's Engineering and <br /> Construction Manager. The Subject Property shall be secured by a gate, which <br /> shall remain locked at all time except when entry area is used for ingress and <br /> egress. City shall be provided with a key to the gate. Permittee shall also, clean <br /> up the site of stockpiled dirt and excess materials at no expense to City. <br /> Without limitation upon the foregoing, Permittee shall, at Permittee's sole <br /> cost and expense, immediately remove and properly dispose of any and all <br /> Agmt-482 6 <br /> DES:djk <br /> F:Shared/Redwood/Council <br /> 05/14/01 <br />
