Prior to approval and execution of this Agreement by the Parties, <br /> the Developer prepared and submitted to the City, and the City approved a <br /> Schematic Design package far the development of the Project on the Site. <br /> Within the time set forth in the Performance Schedule(Exhibit D}, the <br /> Deve�oper shall prepare and submit ta the City a 1:50 scale model of the <br /> project as defined by the Schemahc Design package; provided however <br /> that Developer sha11 not be required to expend mare than Eight Thousand <br /> Dollars($$,000) to produce snch scale model. The model shall be <br /> constructed of balsa wood or other material acceptable to the City that <br /> shows su#�icient detail of buiIding articulation and the buildings' <br /> relationship to on- and off-site improvements, such as street trees, curb, <br /> gutter and sidewalks alang Middlefield Raad ar�d Winslow Street to <br /> include the base improverx�ents necessary to create traffic irnprovements at <br /> the intersection of Winslow and Hamilton Streets. .............................................28 <br /> The Developer may also prepare and snbmit a Design Development package and <br /> shall prepare and submit a Construction Document package to the City for <br /> review and written approval as and at the times established in the <br /> Performance Schedule (Exhibit D). All design submittals wilt include on- <br /> anc�off-site improvements at a comparable level of design cornpleteness. <br /> Off-site improvements include curb, gutter and sidewalk, street ixees, <br /> street lighting, as well as atl utilities. If prepared, Design Development <br /> plans and specifica�ions shali provide greater detaal (from Schexnatic) of <br /> materia�s,methods and the inter-relation of the builciing construction. <br /> Construction Document package shall be in sufficient detail to obtain a <br /> buildingpermit.....................................................................................................28 <br /> 4.3 City Approval of Development Plans. The City shall apprave or <br /> disapprove the plans, drawings and related documents referred to in <br /> Section 4.2 of this Agreement within the times established in the <br /> Performance Schedule (Exhibit D}. Any disapproval shall state in writing <br /> the reasons for disapproval and the changes that the City requests be <br /> made. Such reasons and such changes must be consistent with the Scope <br /> of Develapment(Exhibit H} and any items previously approved or <br /> deemed approved hereunder by the City. The Develaper,upon receipt of a <br /> c�isapproval based upon powers reseroed by the City hereunder, shatl <br /> revise such plans, drawings and related documents and resubmit them ta <br /> the City as soon as possible after receipt of the notice of disapproval, <br /> provided that in no case shall the City be entitled to require changes <br /> inconsistent with the Scope of Development and any previously approved <br /> items. The Cit}�'s zoning, building and land use reg�alations (whether <br /> contaFned in ordinances,the City's rnunicipal code, conditions of approval <br /> or elsewhere), sha11 be applicable ta the construction and installation of the <br /> Project on the Site by the Developer, pursuant to this Agreement.
